NO OBLIGATION TO PRODUCE. Nothing herein shall be construed to obligate Purchaser to produce, distribute, release, perform or exhibit any motion picture, television, theatrical or other production based upon, adapted from or suggested by the Property, in whole or in part, or otherwise to exercise, exploit or make any use of any rights, licenses, privileges or property granted herein to Purchaser.
NO OBLIGATION TO PRODUCE. It is understood and agreed that Producer shall have complete control of the production and post-production of the Series and shall have no obligation to produce, complete, release, distribute, advertise or exploit the Series, nor to include the Work in the Series as released and Company releases Producer from any liability for any loss or damage Company may suffer by reason of Producer's failure to produce, complete, release, distribute, advertise or exploit such Series. Nothing contained in this Agreement shall constitute a partnership or joint venture by the parties hereto or constitute either party an agent of the other.
NO OBLIGATION TO PRODUCE. Nothing herein will be construed to obligate PGE to produce, distribute, release, perform or exhibit any motion picture, television, theatrical or other production based upon, adapted from or suggested by the Literary Property, in whole or in part, or otherwise to exercise, exploit or make any use of any rights, licenses, privileges or property granted herein to PGE.
NO OBLIGATION TO PRODUCE. If a Participant forfeits its Participating Interest any decision to place the Property into production shall be at the sole discretion of the other and if the Property is in or is placed into production, such other shall have the unfettered right to suspend, curtail or terminate any such operation as it in its sole discretion may determine.
NO OBLIGATION TO PRODUCE. It is understood and agreed that Producer shall have complete control of the production and post-production of the Picture and shall have no obligation to produce, complete, release, distribute, advertise or exploit the Picture, nor to include the Work in the Picture as released and Company releases Producer from any liability for any loss or damage Company may suffer by reason of Producer's failure to produce, complete, release, distribute, advertise or exploit such Picture. Nothing contained in this Agreement shall constitute a partnership or joint venture by the parties hereto or constitute either party an agent of the other.
NO OBLIGATION TO PRODUCE. It is understood and agreed that Company shall have no obligation to produce, complete, release, distribute, advertise or exploit any film or program, and Employee releases Company from any liability for any loss or damage Employee may suffer by reason of Company’s failure to produce, complete, release, distribute, advertise or exploit such programs. Nothing contained in this Agreement shall constitute a partnership or joint venture by the parties hereto.
NO OBLIGATION TO PRODUCE. While Producer shall use best efforts to effect a production hereunder, nothing herein shall be construed to obligate Producer to produce, distribute, release, perform or exhibit a film based upon the Work, in whole or in part, or otherwise to exercise, exploit or make any use of the rights, license, privileges or property gained herein to Producer.
NO OBLIGATION TO PRODUCE. Nothing herein shall be construed to obligate ABG Entertainment to produce, distribute, release, perform or Schedule any motion picture, television, theatrical or other production based upon, adapted from or suggested by the Property, in whole or in part, or otherwise to exercise, exploit or make any use of any rights, licenses, privileges or property granted herein to ABG Entertainment.
NO OBLIGATION TO PRODUCE. Purchaser intends to use the rights sold and granted to it pursuant to Section 1.1 above. However, nothing herein contained shall be interpreted or construed to obligate Purchaser to produce the Show, or exercise any of the other rights, licenses or privileges herein conveyed. In no event shall the Show, the Related Rights or any of them revert to any Seller for Purchaser's failure of use.
NO OBLIGATION TO PRODUCE. Producer shall not be obligated to produce the Work, but agrees to use its best efforts to do so. If for any reason Producer decides not to produce the Work, it shall so notify Composer and Librettist in writing, and in such case all monies due and to become due to Composer and Librettist under this Agreement shall be paid by Producer. In such event, Composer and Librettist may make, or authorize Publisher to make, whatever use of the Work they may choose, including granting the world premiere performance rights to another organization.
