Common use of Night Premium Clause in Contracts

Night Premium. An employee for whom half or more of the regular hours of work fall between 23:00 and 09:00 is entitled to a premium of eighty-five cents ($0.85) for each hour of actual work between 23:00 and 09:00. An employee is not entitled to such a premium when she/he is being paid at the rate provided for overtime. This premium is not added to the basic rate in computing the remuneration for overtime performed. However, this clause does not apply to those employees who have chosen their schedule according to clause 22.02.
