Monetary Relief and Benefits. 1. Defendant agrees to pay the Gross Settlement Fund of Three Million Three Hundred Fifty Thousand Dollars and Zero Cents ($3,350,000.00), exclusive of costs associated with the Settlement Administrator’s duties outlined in Section VI of this Agreement and implementation of the programmatic relief outlined in Section III.A of this Agreement, which shall be the maximum amount necessary and possible pursuant to the terms of this Agreement to fully resolve and satisfy all amounts to be paid to or on behalf of Class Members, any Court-approved Service Award to Named Plaintiffs and any claim for Attorneys’ Fees and Costs approved by the Court.

  • Payment and Benefits In consideration of the promises made in this Release, Employer has agreed to pay Executive the benefits as provided in that certain employment agreement made and entered into as of _________________________, by and between the Parties (the “Employment Agreement”). Executive understands and acknowledges that the benefits described in this Section 2 constitute benefits in excess of those to which Executive would be entitled without entering into this Release. Executive acknowledges that such benefits are being provided by Employer as consideration for Executive entering into this Release, including the release of claims and waiver of rights provided in Section 3 of this Release.

Employees appointed as a Contract Specialist shall not be eligible for reimbursement for uniforms, boots or other ancillary items while serving as a Contract Specialist the specifics which will be noted in the employee’s Contract Specialist agreement.

  • Termination Payments and Benefits Regardless of the circumstances of the Executive’s termination, Executive shall be entitled to payment when due of any earned and unpaid base salary, expense reimbursements and vacation days accrued prior to the termination of Executive’s employment, and other unpaid vested amounts or benefits under Company retirement and health benefit plans, and, as applicable, under Equity Agreements in accordance with their terms, and to no other compensation or benefits.

  • Wages and Benefits Wages, performance sharing opportunities and benefits as identified in this Section 2 are considered to be ongoing obligations and will terminate at the extended expiration of local agreements, rather than at the expiration of this Agreement.

  • Burden and Benefit This Agreement shall enure to the benefit of and be binding upon the parties hereto and their respective heirs, executors, administrators, successors and permitted assigns.
