The "Missed Services" clause defines the procedures and consequences when a party fails to deliver or perform agreed-upon services. Typically, this clause outlines how missed services are identified, the notification process, and any remedies or penalties, such as rescheduling, refunds, or service credits. Its core function is to ensure accountability and provide a clear framework for addressing service lapses, thereby protecting the interests of both parties and minimizing disputes.
Missed Services. It is understood between the parties that a significant proportion of "missed" service reports result from the residents’ failure to place bins out for collection on time. Notwithstanding this, it is agreed that all reported missed services shall be collected as part of the daily work schedule or alternative satisfactory arrangement made. Where reports are received of missed bin(s), the Supervisor shall contact the appropriate crew and seek their assistance in collecting the bin(s). If it is found that a resident has requested a pick-up of a "missed" service more than three times in the previous two month period, which is clearly attributable to the bin being put out late, the matter will be brought to the attention of the Supervisor. The Supervisor shall make arrangements for the resident to be advised in writing that a continuation of the practice will lead to the bin not being picked-up.
Missed Services. It is agreed that some services reported as being "missed" have not been collected, due to residents failing to place the bin out for collection on time. Nonetheless, all reported missed/incomplete/spillage services must be collected as part of the daily work schedule. The driver who is assigned to pick up the bin will be paid $2.00 at the discretion of the operations controller. It is agreed that the operator as directed by the Operations Controller will collect all “missed” services reported as being missed/incomplete/spillage, by the following day. If it is found that the resident is regularly requesting a pick up of a missed service, then Council will advise the resident in writing that the bin will not be picked up.
Missed Services. Counselors under this contract will not charge Clients fees for no-shows or cancellations with less than 24-hr notice. Contractor will provide any agreed-upon reimbursements, payments, or incentives to providers for missed sessions but may proceed with outlined plans for those scenarios.
Missed Services. The following will apply for missed services: 4.1 If a non-presented bin is called in by the driver and the Council advise Collex of a missed service for that address, the driver will not be required to return to collect that bin on the same day. 4.2 If the Council advise Collex of a missed service and there is no record of non-presentation, the driver will be required to collect that bin the same day unless it is a known problem address which has been reported to the Council. 4.3 All reported missed services, whether it is the fault of Collex or the resident, must be collected by the next day and will be allocated to vehicles the next morning if they have not been picked up the same day.

  • Managed Services HP will provide the services as described in a Statement of Work (“SOW”) attached to this Agreement or incorporating it by reference. Each party will appoint a single point of contact as set forth in the SOW who will serve as their primary representative, have overall responsibility for managing performance, and meet with the other party’s representative to review progress. Change requests are governed by the change management procedures as set forth in the SOW.

  • TESTING SERVICES DESCRIPTION This Exhibit contains additional terms and conditions applicable to testing services for digestive disorders (the “Testing Services”) that you may have purchased. The additional terms and conditions in this Exhibit only apply to the services described in this Exhibit.

  • Covered Services You will receive Covered Services under the terms and conditions of this Contract only when the Covered Service is: • Medically Necessary; • Provided by a Participating Provider for in-network coverage; • Listed as a Covered Service; • Not in excess of any benefit limitations described in the Schedule of Benefits section of this Contract; and • Received while Your Contract is in force.

  • Hosted Services 3.1 The Provider hereby grants to the Customer a worldwide, non-exclusive licence to use the Hosted Services for the business purposes of the Customer in accordance with the Documentation during the Term. 3.2 The Provider shall create an Account for the Customer and shall provide to the Customer login details for that Account to enable the Customer to configure and administer the Hosted Services and enable registration of Customer End Users. 3.3 Except to the extent expressly permitted in this Agreement or required by law on a non- excludable basis, the licence granted by the Provider to the Customer under Clause 3.1 is subject to the following prohibitions: (a) the Customer must not sub-license its right to use the Hosted Services; (b) the Customer must not make any alteration to the Platform; and (c) the Customer must not conduct or request that any other person conduct any load testing or penetration testing on the Platform or Hosted Services without the prior written consent of the Provider. 3.5 The Customer shall use reasonable endeavours, including appropriate organisational and technical measures relating to Account access details, to ensure that no unauthorised person may gain access to the Hosted Services using an Account. 3.6 The parties acknowledge and agree that Schedule 2 (Availability SLA) shall govern the availability of the Hosted Services. 3.7 The Customer must ensure that all persons using the Hosted Services with the authority of the Customer or by means of an Account comply with the Terms Of Use. 3.8 The Customer must not use the Hosted Services in any way that causes, or may cause, damage to the Hosted Services or Platform or impairment of the availability or accessibility of the Hosted Services. 3.9 The Customer must not use the Hosted Services: (a) in any way that is unlawful, illegal, fraudulent or harmful; or (b) in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. 3.10 For the avoidance of doubt, the Customer has no right to access the software code (including object code, intermediate code and source code) of the Platform, either during or after the Term. 3.11 The Provider may suspend the provision of the Hosted Services if any amount due to be paid by the Customer to AWS for the benefit of the Provider under this Agreement is overdue, and the Provider has given to the Customer at least 30 days' written notice, following the amount becoming overdue, of its intention to suspend the Hosted Services on this basis.

  • Required Services Consultant agrees to perform the services, and deliver to City the “Deliverables” (if any) described in the attached Exhibit A, incorporated into the Agreement by this reference, within the time frames set forth therein, time being of the essence for this Agreement. The services and/or Deliverables described in Exhibit A shall be referred to herein as the “Required Services.”
