Common use of MAGISTRATE’S COURT JURISDICTION Clause in Contracts

MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any proceedings arising out of this Agreement, the parties hereby consent to the jurisdiction of the Magistrate’s Court otherwise having jurisdiction under Section 28 of the Magistrates’ Court Act, No. 32 of 1944, as amended; notwithstanding that the proceedings are otherwise beyond the jurisdiction of the Magistrate’s Court, this clause 21 shall be deemed to constitute the required written consent conferring jurisdiction upon the said Court pursuant to Section 45 of the Magistrates’ Court Act, No. 32 of 1944, as amended. Notwithstanding the aforegoing, the SELLER shall have the right, at the SELLER’S sole option and discretion to institute proceedings in any other competent Court which may otherwise have jurisdiction.
