Common use of MAGISTRATE’S COURT JURISDICTION Clause in Contracts

MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any proceedings arising out of this agreement, the parties hereby consent to the jurisdiction of the Magistrate’s Court and the Regional Court, otherwise having jurisdiction under Section 28 of the Magistrates’ Court Act 32 of 1944, as amended; notwithstanding that the proceedings would otherwise be beyond the monetary jurisdiction of the Magistrate’s or Regional Court. This clause shall be deemed to constitute the required written consent conferring jurisdiction upon the said Courts, pursuant to the Magistrates’ Court Act of 1944, as amended. Notwithstanding the aforegoing, this shall not preclude either party from approaching the High Court of South Africa for any relief sought.
