Litigation as a Final Resort Sample Clauses

Litigation as a Final Resort. If the Parties cannot resolve the dispute for any reason, including, but not limited to, the failure of either Party to agree to enter into mediation or agree to any settlement proposed by the mediator, any dispute surviving after the Parties have made good faith efforts to resolve the dispute, may be filed in a court of competent jurisdiction in accordance with the provisions of governing law set out in this Agreement.
