Common use of Landscape Plan Clause in Contracts

Landscape Plan. Prior to issuance by the City of any grading permit for the Property, Developer shall submit to the City Planner and obtain the City Planner’s written approval of a final landscape plan, which plan shall be consistent with Exhibit H of this Development Agreement. The landscape plan shall be coordinated with the grading plan. The landscape plan shall include at a minimum the following: a. All trees bordering streets shall be located on unit lots. b. Detail of the privacy hedge. c. Size and configuration of the private park and park amenities. d. Landscaping along the sanitary sewer corridor shall be designed to not interfere with utility access or maintenance. e. Raingardens shall be located on private property and maintained by the homeowner’s association. f. Identify ground cover. g. Illustrate mailbox location and platform details. h. Identify snow storage areas. i. Establish a landscaped buffer yard between the home sites and trail. j. Provision for the full replacement of all diseased or dead plants prior to issuance of each final home occupancy permit. k. Installation of sod between the street curb and front of the as-constructed home on each lot, prior to issuance of each final home occupancy permit. l. Installation of at least one tree (with a minimum of two inches in diameter) within each front yard, prior to the issuance a final home occupancy permit on each lot. m. All landscaped areas shall be irrigated.

Unless otherwise withheld, a temporary home occupancy permit may be issued prior to the completion of items j, k, l, and m with an appropriate escrow provided to the City, or held by a title company, guaranteeing the completion of these items in a timely manner, subject to the review and approval of the City Building Official.
