MUNICIPALITY TO RETAIN Clause Samples
The "Municipality to Retain" clause establishes that the municipality will maintain ownership or control over certain assets, rights, or responsibilities specified in the agreement. In practice, this means that even if other parties are involved in the project or transaction, the municipality does not transfer or relinquish its interest in the designated items, such as land, infrastructure, or regulatory authority. This clause ensures that the municipality preserves its essential interests and prevents unintended loss of control, thereby safeguarding public assets or regulatory powers.
MUNICIPALITY TO RETAIN. In addition to persons in the employ of the Municipality, the Municipality shall retain the following professionals:
a) a consulting/professional civil engineer registered with the Professional Engineers of Ontario (the “Municipality’s Engineer”), for the purpose of reviewing all plans, specifications, engineering documents, contracts, details, elevations and other relevant information as well as the occasional inspection of the construction, repair and maintenance of the Services;
b) the Municipality’s solicitor for the purpose of reviewing all necessary legal matters incidental to the development of the Lands, including, without limiting generality, the preparation of this agreement together with all other documentation required by the Municipality to give effect to this Agreement and/or the development of the Lands;
