Common use of INDIVIDUAL SERVICES AGREEMENT Clause in Contracts

INDIVIDUAL SERVICES AGREEMENT. (“ISA”) This Agreement shall include an ISA developed for each student to whom CONTRACTOR is to provide special education and/or related services. An ISA shall only be issued for students enrolled with the approval of the LEA pursuant to Education Code section 56366 (a)(2)(A). An ISA may be effective for more than one contract year provided that there is a concurrent Master Contract in effect. In the event that this Master Contract expires or terminates, CONTRACTOR, shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized students. Any and all changes to a student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the student’s IEP or by written agreement between the parent and LEA. At any time during the term of this Master Contract, a student’s parent, CONTRACTOR, or XXX may request a review of a student’s IEP subject to all procedural safeguards required by law. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student as a result of lack of provision of services while student was served by the NPS/A. If a parent or LEA contests the termination of an ISA by initiating a due process proceeding with the OAH, CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting is deemed lawful and appropriate by XXX or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States Code. CONTRACTOR shall adhere to all LEA requirements concerning changes in placement. Disagreements between XXX and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c) (2).

INDIVIDUAL SERVICES AGREEMENT. In the event that this Master Contract expires or terminates, CONTRACTOR, CONTRACTOR and the LEA shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized studentsLEA pupils, until such time as a new Master Contract is executed. Any and all changes to a studentLEA pupil’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the studentLEA pupil’s IEP or by written agreement between the parent and LEAIEP/IFSP. At any time during the term of this Master Contract, a studentLEA pupil’s parent, CONTRACTOR, or XXX may request a review of a studentLEA pupil’s IEP IEP/IFSP subject to all procedural safeguards required by law, including notice to and participation by the CONTRACTOR in the IEP Team meeting. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP IEP/IFSP unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life term of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student as a result of lack of provision of services while student was served by the NPS/A. If a parent or LEA XXX contests the termination of an ISA by initiating a due process proceeding with the California Office of Administrative Hearings (hereinafter referred to as “OAH”), CONTRACTOR shall abide by the “stay-stay- put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting interim alternative educational placement is deemed lawful and appropriate by XXX LEA or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States Code. CONTRACTOR shall adhere to all LEA requirements concerning changes in placementOAH. Disagreements between XXX and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or local SELPA office prior to appeal to the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c56366 (C) (2).

INDIVIDUAL SERVICES AGREEMENT. An ISA shall be substantially similar in form and content to the ISA set forth in Exhibit B, attached hereto and incorporated herein by reference. An ISA shall only be issued for LEA students enrolled with the approval of the LEA pursuant to Education Code section 56366 (a)(2)(A56366(a)(2)(A). An ISA may be effective for more than one contract year provided that there is a concurrent Master Contract in effect. In the event that this Master Contract expires or terminates, CONTRACTOR, CONTRACTOR shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized LEA students. CONTRACTOR shall adhere to all the LEA requirements concerning changes in placement. Disagreements between XXX the LEA and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c) (256366(c)(2). Nothing herein shall limit LEA or CONTRACTOR from engaging in alternative dispute resolution. CONTRACTOR disagrees with the language of Education Code section 56366(c)(2), and nothing herein shall constitute a waiver by CONTRACTOR of its rights to challenge that provision.

An ISA shall only be issued for students enrolled with the approval of the LEA pursuant to Education Code section 56366 (a)(2)(A). An ISA may be effective for more than one contract year provided that there is a concurrent Master Contract in effect. In the event that this Master Contract expires or terminates, CONTRACTOR, shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized students. XXX shall provide to CONTRACTOR an ISA within 15 days of an executed IEP for services, except as provided in EXHIBIT P, which requires the LEA to develop an ISA for services within 5 days. Any and all changes to a student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the student’s IEP or by written agreement between the parent and LEAIEP. At any time during the term of this Master Contract, a student’s parent, CONTRACTOR, or XXX may request a review of a student’s IEP subject to all procedural safeguards required by law. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life of the ISA, the CONTRACTOR shall notify the LEA in writing within five ten (510) business days of the last date a service was provided. If DIS is not so provided due to the absence of CONTRACTOR’S Personnel, make up sessions shall be provided within forty-five (45) days of the missed session. If CONTRACTOR shall does not provide any and all subsequent compensatory service hours awarded to student as a result make-up services within forty-five (45) days of lack of provision of services while student was served the missed session(s), by the NPS/A. fiftieth (50) day, CONTRACTOR must submit a schedule, to provide the make-up services on or before the 60th day of the missed sessions(s), or as otherwise agreed to in writing by XXX. Make up services shall occur on, or before the last school day of the year, whichever is earlier. If a parent or LEA contests the termination of an ISA by initiating a due process proceeding with the OAH, CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting is deemed lawful and appropriate by XXX or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States Code. CONTRACTOR shall adhere to all LEA requirements concerning changes in placement. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP unless the CONTRACTOR and the LEA agree otherwise in the ISA. Any and all changes to a student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the student’s IEP or by written agreement between the parent and LEA. At any time during the term of this Master Contract, a student’s parent, CONTRACTOR, or XXX may request a review of a student’s IEP subject to all procedural safeguards required by law. Any and all changes to a LEA student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the LEA student’s IEP or by written agreement between the parent and LEAIEP/IFSP. At any time during the term of this Master Contract, a LEA student’s parent, CONTRACTOR, or XXX may request a review of a LEA student’s IEP IEP/IFSP subject to all procedural safeguards required by law, including notice to and participation by the CONTRACTOR in the IEP Team meeting. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP IEP/IFSP unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life term of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student as a result of lack of provision of services while student was served by the NPS/A. Disagreements between XXX and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or local SELPA office prior to appeal to the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c56366 (C) (2).

INDIVIDUAL SERVICES AGREEMENT. As a condition of this Agreement, an Individual Service Agreement (“ISA”) This Agreement shall include an ISA (Attachment C) will be developed for each LEA student to whom CONTRACTOR PROVIDER is to provide special education and/or related services. An ISA shall only be issued for LEA students enrolled with the approval of the LEA pursuant to Education Code section Section 56366 (a)(2)(A). Any and all changes to a LEA student’s educational placement/program provided under this Master Contract Scope of Work and/or an ISA shall be made solely on the basis of a revision to the LEA student’s IEP or by written agreement between the parent and LEA. At any time during the term of this Master ContractAgreement, a LEA student’s parent, CONTRACTORPROVIDER, or XXX may xxx request a review of a LEA student’s IEP subject to all procedural safeguards required by law. (California Education Code Section 56366(a)(3). Unless otherwise provided in this Master ContractScope of Work, the CONTRACTOR PROVIDER shall provide all services specified in the IEP unless the CONTRACTOR PROVIDER and the LEA agree otherwise in the ISA. (California Education Code sections Sections 56366(a) (5) and Title 5 of the California Code of Regulations Section 3062(e)). When PROVIDER is a NPS/A with an integrated program, PROVIDER shall provide all the CDE-certified related services as specified in the LEA’s ISA and student’s IEP. Lack of qualified personnel may result in proration of the basic education rate for integrated programs equal to the rate as paid to other NPS/A for same related service. In the event the CONTRACTOR PROVIDER is unable to provide a specific service at any time during the life of the ISA, the CONTRACTOR PROVIDER shall notify the LEA in writing within five ten (510) business days of the last date a service was provided. CONTRACTOR PROVIDER shall provide any and all subsequent compensatory service hours awarded to student as a result of lack of provision of services while student was served by the NPS/A. LEA shall compensate PROVIDER for the compensatory service hours at the rates specified by the current contract unless billed for previously or included in a bundled rate. If a parent or LEA contests the termination of an ISA by initiating a due process proceeding with the OAH, CONTRACTOR the PROVIDER shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting interim alternative educational setting is deemed lawful and appropriate by XXX the LEA, or OAH consistent with Section 1415 (k)(1)(71415(k)(1)(7) of Title 20 of the United States Code. CONTRACTOR The PROVIDER shall adhere to all LEA requirements concerning changes in placement. Disagreements between XXX the VCOE/LEA and CONTRACTOR PROVIDER concerning the formulation of an ISA or the Master Contract Scope of Work may be appealed to the Ventura County Superintendent Office of Schools of the County where the LEA is located, Education or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section Section 56366(c) (2).

INDIVIDUAL SERVICES AGREEMENT. (“ISA”) This Agreement Master Contract shall include an ISA developed for each LEA student to for whom CONTRACTOR is to provide special education and/or related services. An ISA shall be substantially similar in form and content to the ISA set forth in Exhibit B, attached hereto and incorporated herein by reference. An ISA shall only be issued for LEA students enrolled with the approval of the LEA pursuant to Education Code section 56366 (a)(2)(A56366(a)(2)(A). An ISA may be effective for more than one contract year provided that there is a concurrent Master Contract in effect. In the event that this Master Contract expires or terminates, CONTRACTOR, CONTRACTOR shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized LEA students. Any and all changes to a LEA student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the LEA student’s IEP or by written agreement between the parent and LEAIEP. At any time during the term of this Master Contract, a LEA student’s parent, CONTRACTOR, or XXX LEA may request a review of a LEA student’s IEP subject to all procedural safeguards required by law. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP unless the CONTRACTOR and the LEA agree otherwise in the ISA. ISA (California Education Code sections 56366(a) (556366(a)(5) and 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student as a result of lack of provision of services while student was served by the NPS/A. If a parent or LEA contests the termination of an ISA by initiating a due process proceeding with the OAH, CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or otherwise. CONTRACTOR shall abide by the “stay-put” requirement of state and federal law when placement in an Interim Alternative Educational Setting interim alternative educational setting is deemed lawful and appropriate made by XXX the LEA or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States CodeU.S.C. section 1415(k)(1). CONTRACTOR shall adhere to all the LEA requirements concerning changes in placement. Disagreements between XXX the LEA and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c) (256366(c)(2). Nothing herein shall limit LEA or CONTRACTOR from engaging in alternative dispute resolution. CONTRACTOR disagrees with the language of Education Code section 56366(c)(2), and nothing herein shall constitute a waiver by CONTRACTOR of its rights to challenge that provision.

In the event that this Master Contract expires or terminates, CONTRACTOR, shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized students. Any and all changes to a student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the student’s IEP or by written agreement between the parent and LEAIEP. At any time during the term of this Master Contract, a student’s parent, CONTRACTOR, or XXX may request a review of a student’s IEP subject to all procedural safeguards required by law. Unless otherwise provided specified in Section 60 related to Emergency Closures in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP IEP/ISA, unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and Title 5 of the California Code of Regulations, section 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life term of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student students as a result of lack of provision of services while the student was served by the NPS/A. NPS or NPA and for which the CONTRACTOR was paid under the ISA. The LEA is responsible for ensuring that compensatory service hours awarded to the student are provided, whether by CONTRACTOR or by XXX xxxxxxxxx. For services not included prior paid invoices, payment for compensatory service hours will be agreed upon by CONTRACTOR and XXX and will be based upon the attached Rate Schedule. If a parent or LEA contests the termination of an ISA by initiating a due process proceeding with the OAH, CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting is deemed lawful and appropriate by XXX or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States Code. CONTRACTOR shall adhere to all LEA requirements concerning changes in placement. Disagreements between XXX and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be directed to the Senior SELPA Administrator and may be appealed to the County Superintendent of Schools of the County where the LEA is located, or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c) (2).

When CONTRACTOR is a nonpublic school/agency with an integrated program, CONTRACTOR shall provide all the CDE-certified Related Services as specified in the LEA’s ISA and student’s IEP. Any and all changes to a student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the student’s IEP or by written agreement between the parent and LEA. At any time during the term of this Master Contract, a student’s parent, CONTRACTOR, or XXX may request a review of a student’s IEP subject to all procedural safeguards required by law. Unless otherwise provided specified in Section 61 related to Emergency Closures in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP IEP/ISA, unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and Title 5 of the California Code of Regulations, section 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life term of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student students as a result of lack of provision of services while the student was served by the NPS/A. NPS or NPA and for which the CONTRACTOR was paid under the ISA. The LEA is responsible for ensuring that compensatory service hours awarded to the student are provided, whether by CONTRACTOR or by XXX xxxxxxxxx. For services not included in prior paid invoices, payment for compensatory service hours will be agreed upon by CONTRACTOR and XXX and will be based upon the attached Rate Schedule. If a parent or LEA contests the termination of an ISA by initiating a due process proceeding with the OAHOffice of Administrative Hearings, CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting is deemed lawful and appropriate by XXX or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States Code. CONTRACTOR shall adhere to all LEA requirements concerning changes in placement. Disagreements between XXX and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be directed to the SELPA and/or may be appealed to the County Superintendent of Schools of the County where the LEA is located, or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c) (2).

INDIVIDUAL SERVICES AGREEMENT. (“ISA”) This Agreement contract shall include an ISA developed for each student to whom CONTRACTOR is to provide special education and/or related services. An ISA shall only be issued for students enrolled with the approval of the LEA Shasta SELPA/District of Residence pursuant to Education Code section 56366 (a)(2)(A). An ISA may be effective for more than one contract year provided that there is a concurrent Master Contract in effect. In the event that this Master Contract expires or terminates, CONTRACTOR, shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA Shasta SELPA/District of Residence for so long as CONTRACTOR is servicing authorized students. Any and all changes to a student’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the student’s IEP or by written agreement between the parent and LEAIEP. At any time during the term of this Master Contract, a student’s parent, CONTRACTOR, or XXX Shasta SELPA/District of Residence may request a review of a student’s IEP subject to all procedural safeguards required by law. If a parent or LEA Shasta SELPA/District of Residence contests the termination of an ISA by initiating a due process proceeding with the OAH, CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting interim alternative educational placement is deemed lawful and appropriate by XXX Shasta SELPA/District of Residence or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States CodeOAH. CONTRACTOR shall adhere to all LEA Shasta SELPA/District of Residence requirements concerning changes in placement. Disagreements between XXX Shasta SELPA/District of Residence and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA Shasta SELPA/District of Residence is located, or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c) (2).

An ISA may be effective for more than one contract year provided that there is a concurrent ISAs are void upon termination or expiration of the Master Contract in effectContract. In the event that this Master Contract expires or terminates, CONTRACTOR, CONTRACTOR and the LEA shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized studentsLEA pupils, until such time as a new Master Contract is executed. Any and all changes to a studentLEA pupil’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the studentLEA pupil’s IEP or by written agreement between the parent and LEAIEP/IFSP. At any time during the term of this Master Contract, a studentLEA pupil’s parent, CONTRACTOR, or XXX may request a review of a studentLEA pupil’s IEP IEP/IFSP subject to all procedural safeguards required by law, including notice to and participation by the CONTRACTOR in the IEP Team meeting. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP IEP/IFSP unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life term of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student as a result of lack of provision of services while student was served by the NPS/A. If a parent or LEA XXX contests the termination of an ISA by initiating a due process proceeding with the California Office of Administrative Hearings (hereinafter referred to as “OAH”), CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting interim alternative educational placement is deemed lawful and appropriate by XXX LEA or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States Code. CONTRACTOR shall adhere to all LEA requirements concerning changes in placementOAH. Disagreements between XXX and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or local SELPA office prior to appeal to the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c56366 (C) (2).

At any time during the term of this Master ContractAgreement, a LEA student’s parent, CONTRACTOR, or XXX LEA may request a review of a LEA student’s IEP subject to all procedural safeguards required by law. Unless otherwise provided in this Master ContractAgreement or in the IEP or ISA, the CONTRACTOR shall provide all services specified in the IEP unless the CONTRACTOR and the LEA agree otherwise in the ISAIEP. In the event the CONTRACTOR is unable to provide a specific service which it agreed to provide at any time during the life of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was providedcommercially reasonable period. If a parent or LEA contests the termination of an ISA by initiating a due process proceeding with the OAH, CONTRACTOR shall abide by the “stay-put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting interim alternative educational placement is deemed lawful and appropriate by XXX LEA or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States CodeOAH. CONTRACTOR shall adhere to all LEA requirements concerning changes in placement. Disagreements between XXX LEA and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c) (2).

INDIVIDUAL SERVICES AGREEMENT. (“ISA”) This Agreement contract shall include an ISA Individual Services Agreement (ISA) developed for each student LEA pupil to whom CONTRACTOR is to provide special education and/or related services. An ISA shall only be issued for students LEA pupils enrolled with the approval of the LEA pursuant to Education Code section 56366 (a)(2)(A). An ISA may be effective for more than one contract year provided that there is a concurrent ISAs are void upon termination or expiration of the Master Contract in effectContract. In the event that this Master Contract expires or terminates, CONTRACTOR, CONTRACTOR and the LEA shall continue to be bound to all of the terms and conditions of the most recent executed ISAs between CONTRACTOR and LEA for so long as CONTRACTOR is servicing authorized studentsLEA pupils. Any and all changes to a studentLEA pupil’s educational placement/program provided under this Master Contract and/or an ISA shall be made solely on the basis of a revision to the studentLEA pupil’s IEP or by written agreement between the parent and LEAIEP/IFSP. At any time during the term of this Master Contract, a studentLEA pupil’s parent, CONTRACTOR, or XXX may request a review of a studentLEA pupil’s IEP IEP/IFSP subject to all procedural safeguards required by law, including notice to and participation by the CONTRACTOR in the IEP Team meeting. Unless otherwise provided in this Master Contract, the CONTRACTOR shall provide all services specified in the IEP IEP/IFSP unless the CONTRACTOR and the LEA agree otherwise in the ISA. (California Education Code sections 56366(a) (5) and 3062(e)). In the event the CONTRACTOR is unable to provide a specific service at any time during the life term of the ISA, the CONTRACTOR shall notify the LEA in writing within five (5) business days of the last date a service was provided. CONTRACTOR shall provide any and all subsequent compensatory service hours awarded to student as a result of lack of provision of services while student was served by the NPS/A. If a parent or LEA XXX contests the termination of an ISA by initiating a due process proceeding with the California Office of Administrative Hearings (hereinafter referred to as “OAH”), CONTRACTOR shall abide by the “stay-stay- put” requirement of state and federal law unless the parent agrees otherwise or an Interim Alternative Educational Setting interim alternative educational placement is deemed lawful and appropriate by XXX LEA or OAH consistent with Section 1415 (k)(1)(7) of Title 20 of the United States Code. CONTRACTOR shall adhere to all LEA requirements concerning changes in placementOAH. Disagreements between XXX and CONTRACTOR concerning the formulation of an ISA or the Master Contract may be appealed to the County Superintendent of Schools of the County where the LEA is located, or local SELPA office prior to appeal to the State Superintendent of Public Instruction pursuant to the provisions of California Education Code section 56366(c56366 (C) (2).
