FUNCTIONS OF MANAGEMENT. The Union agrees that the Employer has the exclusive right and power to manage its business, to direct the working forces and to suspend, discharge or discipline employees for just and sufficient cause, to hire, promote, demote, transfer or lay off employees, to establish and maintain reasonable rules and regulations covering the operation of the stores, provided however, that any exercise of these rights and powers in conflict with any of the provisions of this Agreement shall be subject to the provisions of the grievance procedure as set out herein. Should an adjustment in the full-time work force become necessary during the lifetime of this Collective Agreement as a direct result of the installation of Scanner Cash Register equipment, the Employer and the Union will meet to discuss an equitable solution to the problem at least thirty days prior to the implementation of the adjustment. Such discussion will not impede the Employer’s right to initiate the necessary adjustment. The question of the correctness of the Employer’s decision may be subject to the decision of a Board of Arbitration or a single Arbitrator under the provisions of Article of the Collective Agreement. The Union agrees that the Employer has the exclusive right and power to study or introduce new or improved production and/or handling methods or facilities and the Union agrees to co-operate with the Employer in the installation of any such methods and in the education of its members for the necessity of such changes and improvements. The above rights shall be exercised subject to the provisions of the grievance procedure as set forth in this Agreement. The parties agree that the foregoing enumeration of Management’s rights shall not be deemed to exclude other functions of Management not specifically covered in this Agreement. The Employer, therefore, retains all rights not otherwise specifically covered in this Agreement.
