Common use of Exercising Management Rights Clause in Contracts

Exercising Management Rights. Except as provided specifically herein, nothing in this Agreement shall limit the Employer in the exercise of its function of Management, and without restricting the generality of the foregoing, the Employer specifically reserves the absolute right to operate and manage its affairs and facilities, including the right to hire; the right to discipline and discharge employees for just cause; determine job content; assign and schedule work; establish methods, processes and means of performing work; assess the performance of work by employees; design and implement training programs; determine the number of employees to be employed, the duties to be performed and establish and enforce policy and procedures as appropriate.
