The Joint Authority shall not exempt the contractor from or vary the following conditions of a contract without prior approval of the Ministerial Council: the Joint Authority's or the contractor's production shares; the operating cost recovery provisions; the term of the contract; the block relinquishment provisions; the annual contract service fee; obligations aimed at protecting the environment and preventing and cleaning up pollution as provided under the Treaty including the Petroleum Mining Code and the contract; and the exploration work program required to be performed by a contractor in the first three (3) years of a contract.7

City budget decisions are subject to the discretion of the Mayor and the Board of Supervisors. Contractor’s assumption of risk of possible non-appropriation is part of the consideration for this Agreement. THIS SECTION CONTROLS AGAINST ANY AND ALL OTHER PROVISIONS OF THIS AGREEMENT.
