Excess Deferrals or Excess Salary Deferralsshall mean those Elective Deferrals that are includible in a Participant’s gross income to the extent such Participant’s Elective Deferrals for a calendar year exceed the dollar limitation under Code section 402(g), as determined by the Secretary of the Treasury for a calendar year. Such limitation shall apply to the individual Participant and shall apply to all qualified cash or deferred arrangements, as described in Code section 401(k), any Simplified Employee Pension Plan cash or deferred arrangement as defined in Code section 408(k) to the extent such contributions are not includible in the individual’s gross income for the taxable year on account of Code section 402(h)(1)(B), any eligible deferred compensation plan under Code section 457, any plan as described under Code section 501(c)(18), and any employer contributions made on behalf of a Participant for the purchase of an annuity contract under Code section 403(b) pursuant to a salary deferral agreement.

  • Elective Deferrals An Employee will be eligible to become a Contributing Participant in the Plan (and thus be eligible to make Elective Deferrals) and receive Matching Contributions (including Qualified Matching Contributions, if applicable) after completing 1 (enter 0, 1 or any fraction less than 1) Years of Eligibility Service.
