Estrutura. Este Contrato estabelece uma estrutura que permitirá à Red Hat fornecer Software e Serviços ao Cliente. O termo “Software” significa o Red Hat Enterprise Linux, o JBoss Enterprise Middleware e outros programas de software sob a marca da Red Hat, de suas Afiliadas e/ou de terceiros, incluindo todas as mudanças, acréscimos ou futuros aprimoramentos lançados pela Red Hat. Os serviços específicos (os “Serviços”) e/ou os Software que a Red Hat fornecerá ao Cliente serão descritos em um Formulário de Pedido assinado pelas partes ou de outra forma aceito pela Red Hat, o qual poderá consistir em (a) um ou mais formulários de pedido, descriçõies de trabalho (sow), ordens de serviço ou documentos similares mutuamente acordados, ou (b) um pedido realizado pelo Cliente através da loja on-line da Red Hat acessível por meio do website da Red Hat. As partes concordam que os termos deste Contrato regerão todas as compras e a utilização, pelo Cliente, de Software e Serviços, a menos que as partes acordem, por escrito, de forma diversa. Referência ao termo “dias” significa dias corridos.
