Discharge of Obligation to Pay. Effective on the date that Plaintiff receives the full amount specified in Paragraph 8.1, to Xxxxxxxx Xxxxxx and the Xxxxx Xxxxxxx Foundation of ACLU, Inc., Plaintiff releases and forever discharges Defendant from any and all obligation to make payment under this Agreement, including from Plaintiff’s Attorneys’ non-payment or underpayment to Plaintiff for any reason whatsoever.

Discharge of Obligation to Pay. Notwithstanding the provision of any receipt by the Trustee, the obligation of the Borrower and the Guarantor to make a payment under this Agreement and the Security Documents or any of them shall only be discharged when the Trustee is satisfied that the person making the payment was solvent at the time the payment was made or on the expiry of the period during which any payment made to the Trustee under this Agreement and the Security Documents or any of them may be avoided or voidable.
