(a) Prior to the Commencement of Construction of the Horizontal Infrastructure Improvements, the DIA will have assigned to the Property the following development rights pursuant to the Downtown DRI (the “Development Rights”), all of which have been previously approved by the board of the DIA (the “DIA Board”): Residential Units, Multi-Family: 500 units Hotel: 250 rooms Commercial: 200,000 square feet Office: 50,000 Square feet
