Demolition Contract. (a) Upon request by the City, Borrower shall submit to the City for its approval a draft o f the proposed contract for the demolition o f the Existing Improvements. Al l demolition work and professional are to be performed by persons or entities licensed or otherwise authorized to perform the applicable work or service in the State of California. The City's approval o f the demolition contract shall not be deemed to constitute approval of or concurrence with any term or condition o f the demolition contract except as such term or condition may be required by this Agreement. (b) Upon receipt by the City o f the proposed contract, the City shall promptly review same and approve or disapprove it within (5) daysdays. I f the demolition contract is not approved by the City, the City shall set forth in writing and notify Borrower o f the City's reasons for withholding such approval. Borrower shall thereafter submit a revised demolition contract for City approval, which approval is to be granted or denied in five (5) days in accordance with the procedures set forth above.
Demolition Contract. Seller is a party to that certain Proposal/Contract 2020-0357 – Revised Note #20 dated April 2, 2020 by and between Seller and Thunder Demolition, Inc., a Florida corporation (the “Contractor”) for the SEC Assemblage Demolition, a copy of which is attached hereto as Exhibit “A” (the “Demolition Contract”). Purchaser hereby consents to the Demolition Contract. Seller represents and warrants that, as of the Effective Date, (a) Seller has paid to the Contractor an amount equal to Fifty Thousand Six Hundred Seventy Nine and 16/100 Dollars ($50,679.16) under the Demolition Contract for the SEC Assemblage Demolition (the “Completed Payment”) and (b) the outstanding amount due under the Demolition Contract for the completion of the SEC Assemblage Demolition is Two Hundred Two Thousand Seven Hundred Fifteen and 84/100 Dollars ($202,715.84) (the “Outstanding Payment”). At Closing, (a) Seller shall provide Purchaser with a partial lien waiver executed by the Contractor, which shall certify that the Completed Payment has been made and that no other amounts are due under the Demolition Contract except for the Outstanding Payment, (b) Purchaser shall receive a credit against the Purchase Price in an amount equal to Thirty Thousand Three Hundred Sixteen and 64/100 Dollars ($30,316.64), and (c) Purchaser shall assume Seller’s obligation to pay the Outstanding Payment and other obligations of Seller under the Demolition Contract arising from and after the Closing Date, pursuant to an assignment and assumption of the Demolition Contract in the form attached hereto as Exhibit “B”, which shall be executed by Seller and Purchaser at Closing. Notwithstanding anything to the contrary contained in Section 7(c) of the Agreement, Seller and Purchaser acknowledge and agree that (a) Seller shall not be obligated to complete the SEC Assemblage Demolition prior to Closing and (b) Seller shall not be entitled to the SEC Assemblage Reimbursement or any other credits for amounts expended by Seller in connection with the SEC Assemblage Demolition, including, without limitation, the Completed Payment made by Seller to the Contractor pursuant to the Demolition Contract.
Demolition Contract. Until all work thereunder has been performed, the Demolition Contract shall remain in full force and effect, shall not have been modified without Lender’s prior written consent, which consent shall not be unreasonably withheld, conditioned or delayed, and no material default or event of default shall exist thereunder by Borrower. During the continuance of an event of default by Demolition Contractor under the Demolition Contract (following any required notice to such Demolition Contractor and the expiration of any applicable cure period), Lender shall be entitled to withhold the portion of a Disbursement to Borrower which would be otherwise payable to the Demolition Contractor absent such event of default.

  • Construction Contract If federal funds are included as part of the financing of the non-OPWC portion of the Project, federal law may prevail, including, but not limited to, application of ▇▇▇▇▇ ▇▇▇▇▇ prevailing wage rates, the ▇▇▇▇▇▇▇▇ “Anti-Kickback” Act, the Contract Work Hours and Safety Standards Act, and any federal environmental regulations. Recipient is solely responsible for ensuring compliance with federal requirements applicable to its Local Subdivision Contribution. Notwithstanding the above, the following provisions apply to construction contracts under this Agreement:

  • Construction Contracts Item A: Enter the total dollar amount of all contacts awarded on the project/ program. Item B: Enter the total dollar amount of contracts connected with this project/program that were awarded to Section 3 businesses.

  • Demolition work (i) As of 1 March 2024 where Employees are directly performing demolition works that would require a demolition permit that allows the performance of such work, they will receive the amount of $9.70 per hour or the site allowance, whichever is the greater. This allowance will be adjusted annually in accordance with CPI (All Groups, Melbourne) movements measured in the twelve month period ending the previous December quarter effective as of 1 March 2025, rounded to the nearest 5 cents. (ii) As of 1 March 2024 where Employees are employed in connection with, and on work, with employees of demolition contractors (ie. working within the demolition zone and/or subject to the additional disabilities arising from that demolition), they will receive the amount of $8.70 per hour or the site allowance, whichever is the greater. This allowance will be adjusted annually in accordance with CPI (All Groups, Melbourne) movements measured in the twelve month period ending the previous December quarter effective as of 1 March 2025, rounded to the nearest 5 cents.

  • Demolition The Lessor shall remove existing abandoned electric, telephone, and data cabling and devices, as well as any other improvements or fixtures in place, to accommodate the Government’s requirements. Any demolition of existing improvements that is necessary to satisfy the Government’s layout shall be done at the Lessor’s expense.

  • Construction Contract Documents The Construction Contract Documents shall consist of the plans and specifications prepared by the Engineer, and any addenda and change orders thereto, and the Owner-Contractor Agreement, all of which shall be compatible and consistent with this Agreement.
