Delivery of Executed Loan Documents. Borrower shall have delivered to the Administrative Agent, for the benefit of, and for delivery to, the Administrative Agent and the Syndication Parties, the following documents, each duly executed by Borrower and any other party thereto:

Borrower and the Required Lenders shall have delivered to the Administrative Agent, for the benefit of, and for delivery to, the Administrative Agent and the Syndication Parties, this First Amendment (or their approval thereof, in the case of Voting Participants), duly executed.

Delivery of Executed Loan Documents. Lender shall have received this Fifth Supplement, which may be in counterparts, executed by Borrower and Lender together with the EPC Collateral Assignment Agreement in a form acceptable to the Lender and executed by Borrower and Delta-T.
