Common use of Delay Time Clause in Contracts

Delay Time. The Company will pay delay time for mechanical breakdowns to the trucks or trailers, adverse weather conditions including unsafe driving conditions, road closures from accidents or other incidents where driver is unable to detour. Delay time will be paid if the driver is instructed to be at work at a specific hour and no equipment is available at the start of the shift. It is recognized by the parties that certain customers may have additional security procedures or product testing protocols that extend delivery time anticipated and compensated under ‘variable pay’. In the event there are regular delays caused by the above noted circumstances, the drivers can either wait and continue with the Variable Pay compensation or can opt to be paid on an hourly basis for all time spent at that customer. When paid hourly, the driver will not be eligible to charge Customer Time or volume rates.
