The Delay Time clause defines the conditions under which a party is permitted additional time to complete their contractual obligations due to delays beyond their control. Typically, this clause outlines what constitutes a valid delay—such as extreme weather, supply chain disruptions, or regulatory holdups—and the process for notifying the other party and requesting an extension. Its core function is to provide a fair mechanism for adjusting deadlines, thereby protecting parties from penalties or breach of contract when delays are caused by unforeseen events.
Delay Time. It is the intent of the parties to make the driver whole for all justified delay time, such as waiting for late loads, unscheduled on property work, accident delay or on road equipment breakdown. Any disputes will be referred to the Joint Premium Service Review Committee.
Delay Time. All uniformed employees on scheduled or special crews shall be paid volunteer time (one and one-half times the basic rate) for any extra time caused by being late when relieved or running vehicles into surface carhouses or garages when such delay is ten minutes or over. The overtime premium will apply on subway crews and S.R.T. crews when relieved or running trains in after five minutes because of delays in the system beyond the control of the operator. Such delays would include accumulated time on swing runs.

Any such compensation paid to an owner-operator is not to be deducted from his truck earnings. With respect to owner-operators only, any delay arising out of breakdown of tractor and/or tire failure is to be excluded. Call-in pay received by owner-operators shall not be deductible from truck earnings. (d) Owner-operators shall be paid the full hourly rate for all time spent in excess of fifteen (15) minutes per car for delays at deliveries. This shall apply to both full loads and split loads and the fifteen (15) minutes will start after owner-operators have unloaded vehicles with the understanding that other unnecessary delays will still be paid at the hourly rate of pay as prescribed in the present Agreement in addition to the above. The owner-operator shall provide the Employer with proof of the delay as required by the Employer. This shall not be charged back to the owner-operator. (e) It is understood and agreed that as a driver, the lessor (owner-operator) is entitled to the daily guarantee specified in Article 46, Section 1, and the other monetary items specified in other articles in this Agreement.
Delay Time. The Company will pay delay time for mechanical breakdowns to the trucks or trailers, adverse weather conditions including unsafe driving conditions, road closures from accidents or other incidents where driver is unable to detour. When sleeper team runs require waiting time at the furthest point, such waiting time may be non-paid, but not to exceed two (2) hoursone (1) hour.
