Damage or Theft of Personal Property. All personal property brought into the Premises shall be at the risk of the Tenant only and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any acts of co-tenants, or other occupants of the Building, or any other person, except, with respect to damage to the Premises, as may be occasioned by the negligent or willful act of the Landlord, its employees and agents.
Damage or Theft of Personal Property. All personal property brought into Demised Premises by Tenant, or Tenant's employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act of co-tenants, occupants, invitees or other users of the Building or any other person unless caused by the gross negligence or willful misconduct of Landlord. Landlord shall not at any time be liable for damage to any property in or upon the Demised Premises, which results from power surges or other deviations from the constancy of electrical service or from gas, smoke, water, rain, ice or snow which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever unless caused by the gross negligence or willful misconduct of Landlord.

All personal property brought into the Premises or improvements and alterations made by Tenant (whether or not approved by Landlord), and by Tenant’s members, occupants, employees, agents, guests, licensees, or invitees, shall be at the risk of Tenant only, and unless due to Landlord’s gross negligence or willful misconduct, Landlord shall not be liable for theft thereof or any damage or loss of any kind whatsoever. Unless due to Landlord’s gross negligence, Landlord shall not at any time be liable for damage to any property in or upon the Premises, which results from fire, gas, smoke, water, rain, ice, snow, wind, or leaks from any part of the Premises or from the pipes or plumbing work, or from any other place whatsoever. In the event of any insurance claim that can be made against one or more of the insurance policies of Landlord, Tenant, and Tenant’s members and occupants, the insurance policies of Tenant and Tenant’s members and occupants shall be primary with respect to any sickness, accident, injury or death, or for loss or damage to any property, or for any other legal liabilities which might be imposed for damage to persons or property. The terms of this Paragraph shall survive any termination of this Lease.

As a material part of the consideration to Landlord, all personal property brought into the Premises by Tenant, or Tenant's employees or business visitors, shall be at the risk of Tenant only, and Landlord shall not be liable for theft thereof or any damage thereto occasioned by any act or omission of co-tenants, occupants, invitees or other users of the Building or any other person. Landlord shall not at any time be liable for damage to any property in or upon the Premises which results from power surges or other deviations from the constancy of electrical service or from gas, smoke, water, or rain, which issues or leaks from or forms upon any part of the Building or from the pipes or plumbing work of the same, or from any other place whatsoever. Notwithstanding the foregoing, Landlord shall be liable for theft or any damage to all personal property brought into the Premises by Tenant, or Tenant's employees or business visitors if such theft thereof or any damage thereto is occasioned by the gross negligence or willful misconduct of Landlord or Landlord's agents, employees or invitees.

Tenant acknowledges Landlord shall not be providing any security for the Premises, Buildings or Project. Landlord shall not at any time be liable for damage to any property in or upon the Premises which results from power surges or other deviations from the constancy of electrical service or from gas, smoke, water, or rain, which issues or leaks from or forms upon any part of the Buildings or from the pipes or plumbing work of the same, or from any other place whatsoever.
