Common use of Compensable Travel Time Clause in Contracts

Compensable Travel Time. Notwithstanding any other contract provision, departmental policy or practice, the travel time of employees who are covered by the Fair Labor Standards Act shall be considered as time worked only if it meets the definitions and requirements of travel time in Sections 785.34 through 784.41 of Title 29 of the Code of Federal Regulations. In applying Section 785.37 (home to work on special one-day assignment in another city), for purposes of consistent application, "another city" is defined as a work location in excess of a 25-mile radius from the employee's headquarters.
