Common use of Clearing the File Clause in Contracts

Clearing the File. The record of an employee shall not be used against him/her at any time after eighteen (18) months following a suspension or disciplinary action, provided that there is no recurrence of disciplinary action within the eighteen (18) month period. The parties mutually agree that all disciplinary action in regards to resident abuse will remain on file permanently. At the request of an employee, her records of discipline for other than resident abuse will be removed from her file after eighteen (18) months.

The parties mutually agree that all disciplinary action All leaves of absences in regards to excess of ten (10) days shall not count toward either of the above periods. Notwithstanding the above, cases where an employee is engaged in resident abuse will shall remain on the employee file permanently. At the request of an employee, her records of discipline for other than resident abuse will be removed from her file after eighteen (18) months.

At the request of an employee, her records of discipline for other than resident abuse will be removed from her file after eighteen twenty-four (1824) months.
