Class Schedule Development. 12.1 Unit Members shall be entitled to continue with teaching, counseling, and librarian duties to the extent that the program continues to have such needs. That is to say that the Unit Member shall have first right of refusal with respect to continued teaching, counseling, and librarian duties that they have performed historically, provided such duties remain a part of the program requirements. It is the scheduling ▇▇▇▇’▇ responsibility to complete the schedule, in consultation with Unit Member(s), based on the need of the specific program.
12.1.1 First right of refusal is defined as the right to continue to counsel or to teach a class that one is teaching.
12.2 Unit Members shall retain first right of refusal to all EP, intersession, and/or summer assignments.
12.3 While recommendations of all personnel will be seriously considered, it is the supervising ▇▇▇▇'▇ responsibility to make the decisions for a schedule.
12.4 In the event of irreconcilable differences of opinion, the Unit Member may request a conference be held with the ▇▇▇▇ and appropriate College Vice President, or Yuba College President in the case of Clear Lake. The appropriate College Vice President, or Yuba College President in the case of Clear Lake, will render a decision. Consultation shall not override a Unit Member’s first right of refusal.
Class Schedule Development. Proposed class schedules and teaching assignments shall be developed cooperatively by the faculty members of an academic area with the Chief Academic Officer or designee. All for-credit course schedules shall be reviewed by the Chief Academic Officer before being finalized. The primary goal of schedule development shall be a schedule that best meets the needs of the College’s students. Any modification to the proposed schedule may be made by the Chief Academic Officer or designee only after notification to the faculty member(s) directly affected by the modification. Faculty members directly affected are only those who would have their teaching assignments changed by the modification. Schedule changes shall not be made arbitrarily or capriciously. Scheduling of faculty teaching assignments to disciplines/program areas shall, to the extent practical, be determined in the following order: Discipline/program is defined as the area the staff member was originally hired for, assigned to, or moved into upon a full-time opening in the discipline/program. Being assigned to a program generally is based upon a request from the Employer to the instructor to become eligible to teach in another or related field. Instructors may also request such an assignment which may or may not be granted in the sole discretion of the Employer. In any event, the Employer maintains its right of assignment.
a. Each faculty member will choose enough course sections to reach 15-16 contact hours of load for the Fall and/or Winter semester. Selection will be made in order of faculty seniority within their discipline/program area based on original date of hire within program/department. Load may include one (1) online course per semester when made available by, and as scheduled by, the Employer.
i. It is the intent of the Bargaining Unit to recognize seniority in two ways.
ii. If a faculty member is hired/appointed into a new program/department from their program/department of original hire, the faculty member maintains seniority rights in regards to longevity of service with the college and with compensation. Seniority for the purpose of class selection within the new department/program will reset to the date of new hire/new appointment.
iii. If a faculty member is asked by the college to explore another academic program/discipline for the betterment of the institution and there is mutual agreement between both the college and the faculty member to explore such an opportunity, the faculty...
