Common use of Certificate of Occupancy Clause in Contracts

Certificate of Occupancy. Tenant shall not at any time use or occupy the Premises in violation of the certificate of occupancy issued for the Premises or for the Building and in the event that any department of the City or State of New York shall hereafter at any time contend and/or declare by notice, violation, order or in any other manner whatsoever that the Premises are used for a purpose which is a violation of such certificate of occupancy whether or not such use shall be a Permitted Use, Tenant shall, upon five (5) days written notice from Landlord, immediately discontinue such use of the Premises. Failure by Tenant to discontinue such use after such notice shall be considered a default in the fulfillment of a covenant of this Lease and Landlord shall have the right to terminate this Lease immediately, and in addition thereto shall have the right to exercise any and all rights and privileges and remedies given to Landlord by and pursuant to the provisions of Articles 17 and 18 hereof.

Failure by Tenant to discontinue such use after such notice shall be considered a default in the fulfillment of a covenant of this Lease and Landlord shall have the right to terminate this Lease immediately, and in addition thereto shall have the right to exercise any and all rights and privileges and remedies given to Landlord by and pursuant to the provisions of Articles 17 and 18 hereof. Landlord shall not, during the Term, amend such Certificate of Occupancy to preclude the Permitted Uses or reduce the number of persons who may occupy the Premises unless otherwise required pursuant to applicable laws.

Subject to Section 6.D(iv), Tenant shall not at any time use or occupy the Premises in violation of the certificate of occupancy issued for the Premises or for the Building and and, in the event that any department of the City of New York or State of New York shall hereafter at any time contend and/or declare by notice, violation, order or in any other manner whatsoever that the Premises are used for a purpose which is a violation of such certificate of occupancy whether or not such use shall be a Permitted Useoccupancy, Tenant shall, upon five (5) days days’ written notice from Landlord, immediately discontinue such use of the PremisesPremises (except as provided in Section 6.D(iv)). Failure by Tenant to discontinue such use after such notice shall be considered a default in the fulfillment of a covenant of this Lease and Landlord shall have the right to terminate this Lease immediately, and in addition thereto shall have the right to exercise any and all rights and rights, privileges and remedies given to Landlord by and pursuant to the provisions of Articles 17 and 18 hereofArticle 20 hereof or otherwise.

Tenant shall not at any time use or occupy the Premises in violation of the certificate of occupancy (a true and correct copy of which has been delivered to Tenant) at such time issued for the Premises or for the Building and in the event that any department of the City or State of New York shall hereafter at any time contend and/or or declare by notice, violation, order or in any other manner whatsoever that the Premises are used for a purpose which is a violation of such certificate of occupancy whether or not such use shall be a Permitted Useoccupancy, Tenant shall, upon five (5) days days' written notice from LandlordLandlord or any Governmental Authority, immediately discontinue such use of the Premises. Failure by Tenant to discontinue such use after such notice shall be considered a default in the fulfillment of a material covenant of this Lease and Landlord shall have the right to terminate this Lease immediately, and in addition thereto shall have the right to exercise any and all rights and privileges and remedies given to Landlord by and pursuant to the provisions of Articles 17 16 and 18 hereof17.
