Certain Terminations Prior to the End Date. If the Employment Period shall have terminated prior to the End Date and such termination of employment is a Qualifying Termination within the meaning of the Severance Plan, then Executive shall be eligible for the compensation and benefits specified in Section 6 of the Severance Plan in accordance with and subject to the terms thereof, including, without limitation, Section 8 thereof. No other benefits shall be paid upon such a Qualifying Termination.

Executive expressly acknowledges that by entering into this Agreement he has waived any right to claim for constructive dismissal at common law.
