Bypassing. (a) Subject to 10(b), you acknowledge and agree that while you are the Service Provider on the Platform, and for one (1) year after you cease using the Platform, you will not, outside the Platform, either directly or indirectly, solicit or attempt to solicit any business, work, income or other benefit, from any Parent whom you came to know about, or with whom you provided services to directly or indirectly, by using the Platform. This provision will apply whether or not the Parent or their representative is still active on the Platform. (b) Clause 10(a) does not apply to Parents if all of their Children are no longer Eligible in accordance with clause 9. (c) PrezentBox may, in its absolute discretion, suspend you from using the Platform or terminate this agreement if it finds or suspects that you have breached or are in breach of this clause 10.
Bypassing. (a) You agree that while you are a Seller on the Website, you will not, either directly or indirectly, solicit or attempt to solicit any business, work, income or other benefit, from any Customer whom you came to know about, or with whom you provided goods or services to directly or indirectly, by using the Website. This provision will apply whether or not the Customer or their representative is still active on the Website. (b) The Company may, in its absolute discretion, suspend you from using the Website if it finds or suspects that you have breached or are in breach of this clause 4.

Bypassing. 1. Bypassing Not Exceeding Effluent Limitations - ▇▇▇▇▇▇ ANGB may allow a bypass to occur which does not cause effluent limitations to be exceeded, but only if it also is for essential maintenance to assure efficient operation. These bypasses are not subject to the provisions in paragraph two. 2. Other Bypassing - In all other situations, bypassing is prohibited unless: a. A bypass is unavoidable to prevent loss of life, personal injury or "severe property damage." b. There are no feasible alternatives to the bypass, such as the use of auxiliary treatment facilities, retention of untreated wastes, or maintenance during normal periods of equipment downtime. This condition is not satisfied if adequate backup equipment should have been installed in the exercise of reasonable engineering judgment to prevent a bypass which occurred during normal periods of equipment downtime or preventive maintenance.

  • Dewatering (a) Where the whole of a site is so affected by surface water following a period of rain that all productive work is suspended by agreement of the Parties, then dewatering shall proceed as above with Employees so engaged being paid at penalty rates as is the case for safety rectification work. This work is typically performed by Employees engaged within CW1, CW2 or CW3 classifications. When other Employees are undertaking productive work in an area or areas not so affected then dewatering will only attract single time rates. (b) Where a part of a site is affected by surface water following a period of rain, thus rendering some areas unsafe for productive work, consistent with the Employer’s obligations under the OH&S Act, appropriate Employees shall assist in the tidying up of their own work site or area if it is so affected. Where required, appropriate Employees will be provided with the appropriate PPE. Such work to be paid at single time rates. Productive work will continue in areas not so affected. (c) To avoid any confusion any ‘dewatering’ time which prevents an Employee from being engaged in their normal productive work is not included in any calculation for the purposes of determining whether an Employee is entitled to go home due to wet weather (refer clauses 32.4 and 32.5)
