Bona Fide Occupational Requirements. (i) The parties recognize that meeting the needs of people supported is of utmost importance. Therefore, the Association will establish bona fide occupational requirements which will be used to determine the acceptance of employees being assigned or transferred to positions within the Bargaining Unit. Such qualifications and requirements shall be those necessary to perform the job function and shall not be established in an arbitrary or discriminatory manner and shall be provided to the Union for each newly created position prior to the position being posted.
