Bar of Participant from Claim When Participant Has Contributed to Injury or Damage, and Participant’s Agreed Indemnity of HFAC for Any Third-Party Claim Arising from Participant’s Actions: It is understood and agreed that if the Child, Parent(s), and/or Temporary Caretaker contributes to the occurrence of any personal injury, wrongful death or property damages by any intentional or negligent actions, such contributory intentional act or negligence shall bar absolutely any claim by the Child, Parent, and/or Temporary Caretaker or anyone else on their behalf against Releasees. If the Child, Parent(s), and/or Temporary Caretaker violates any of his/her duties set forth in this Agreement or under law and thereby injures or damages another person, the person so causing (or in the case of the Minor, the Parents and Temporary Caretaker) shall indemnify, defend and hold harmless the Releasees from and against any and all claims, injuries, costs, damages, losses or suits, including attorney’s fees, brought by or on behalf of anyone, arising out of, concerning, or relating to such injury or damage to the other person, even if such claims allege negligence by Releasees, with said obligation not dischargeable in bankruptcy.

Bar of Participant from Claim When Participant Has Contributed to Injury or Damage, and Participant’s Agreed Indemnity of HFAC for Any Third-Party Claim Arising from Participant’s Actions: It is understood and agreed that if the Child, and/or supervising Parent or Temporary Caretaker contributes to the occurrence of any personal injury, wrongful death or property damages by his, her and/or their intentional or negligent actions, such contributory intentional act or negligence shall bar absolutely any claim by the Child, Parent and/or Temporary Caretaker against HFAC, its stockholders, directors, officers agents, employees, and subcontractors, and the owners of any land or facilities used by HFAC. If the intentional or negligent conduct of the Child, Parent or Temporary Caretaker causes personal injury, wrongful death or property damages to another person, the person so causing shall fully indemnify, defend and hold harmless HFAC therefrom, and this obligation shall not be dischargeable in bankruptcy.

  • Adoption Leave (a) The employee will notify the employer at least ten weeks in advance of the date of commencement of adoption leave and the period of leave to be taken. An employee may commence adoption leave prior to providing such notice, where through circumstances beyond the control of the employee, the adoption of a child takes place earlier.

  • Eligibility for Employer Contribution This section describes eligibility for an Employer Contribution toward the cost of coverage.

  • Maintaining Eligibility for Employer Contribution The employer's contribution continues as long as the employee remains on the payroll in an insurance eligible position. Employees who complete their regular school year assignment shall receive coverage through August 31.
