Common use of Availability Pay Clause in Contracts

Availability Pay. Employees who are exempt from receiv­ing overtime shall receive availability pay as they can be ex­pected to be called out occasionally during off duty times to perform duties associated with their assign­ment and for occasionally being required to work extended shifts. Pilots, Sergeants, Pilot Supervisors and Polygraph Examiner Supervisors shall be eligible to receive $3,800 annually. This article shall not apply to Sergeants covered by the Fair Labor Standards Act (FLSA).
