Common use of Alternative Measures Clause in Contracts

Alternative Measures. Each Party may provide that, in appropriate cases and at the request of the person liable to be subject to the measures provided for in Article 10.47 or 10.48, the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or her disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Alternative Measures. Each Party may provide thatprovide, in accordance with its domestic legislation, that in appropriate cases and at the upon request of the person liable to be subject to the measures provided for in Article 10.47 or 10.48241 and/or Article 242, the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 241 and/or Article 242 if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or her such person disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Alternative Measures. Each A Party may provide that, in appropriate cases and at the upon request of the person liable to be subject to the measures provided for in Article 10.47 12.48 (Other Remedies) or 10.48Article 12.49 (Injunctions), the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 12.48 (Other Remedies) and Article 12.49 (Injunctions) if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or her disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Alternative Measures. Each Party Party, in accordance with domestic law, may provide that, in appropriate cases and at the request of the person liable to be subject to the measures provided for in Article 10.47 or 10.48103 and/or Article 104, the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 103 and/or Article 104 if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or her disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Alternative Measures. Each A Party may provide that, in appropriate cases and at the upon a request of the person liable to be subject to the measures provided for in Article 10.47 259 or 10.48Article 260, the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 these Articles. Such pecuniary compensation shall be paid if that the person liable to be subject to those measure acted unintentionally and without negligence, and if the execution of the measures provided in question Article 259 and 260 would cause him or her this person disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Each Party may provide thatthat the judicial authorities, in appropriate cases and at the upon request of the person liable to be subject to the measures provided for in Article 10.47 or 10.48X.52 (Remedies) and/or Article X.53 (Injunctions), the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 if X.52 (Remedies) and/or Article X.53 (Injunctions),if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or her disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Each Party may provide thatthat its judicial authorities, in appropriate cases and at the request of the person liable to be subject to the measures provided for in Article 10.47 18.52 (Corrective measures) or 10.48Article 18.53 (Injunctions), the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 18.52 (Corrective measures) or 10.48 Article 18.53 (Injunctions) if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or her that person disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Each Party The Parties may provide that, in appropriate cases and at the request of the person liable to be subject to the measures provided for in Article 10.47 or 10.48293 and/or Article 294 of this Agreement, the competent judicial authorities may order pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 those two Articles if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or him/her disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Each Party may provide thatthat the judicial authorities, in appropriate cases and at the request of the person liable to be subject to the measures provided for referred to in Article 10.47 or 10.4816 (Remedies) and/or Article 17 (Injunctions), the competent judicial authorities may order the pecuniary compensation to be paid to the injured party instead of applying the measures provided for in Article 10.47 or 10.48 if 16 (Remedies) and/or Article 17 (Injunctions)if that person acted unintentionally and without negligence, if execution of the measures in question would cause him or her disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.

Each Party may provide thatthat the judicial authorities, in appropriate cases and at the request of the person liable to be subject to the measures remedies provided for in Article 10.47 142 or 10.48143, the competent judicial authorities may are able to order pecuniary compensation to be paid to the injured party instead of applying the measures remedies provided for in Article 10.47 or 10.48 those Articles if that person acted unintentionally and without negligence, if execution of the measures remedies in question would cause him or her disproportionate harm and if pecuniary compensation to the injured party appears reasonably satisfactory.
