AEG. If and insofar the RU submits a train path application, whose passage requires a safety certificate pursuant to Article 7a AEG, it commits itself to the XX Xxxx AG that a RU operates the train journeys which has a safety certificate pursuant to Article 7a AEG. If this RU does not join the ENV concluded between XX Xxxx AG and the notifying RU, an agreement on traffic operation has to be reached between the notifying RU, the RU which operates the train journeys and XX Xxxx. A template is attached as Annex 1 to this Basic Agreement IU. The routes / route segments on which a safety certificate is required can be found in the Infrastructure Register of XX Xxxx AG (ISR). The exceptions pursuant to Article 2 (20) and Article 5 (6) AEG shall remain unaffected by the above provision.
