ADDITIONAL OPERATING REQUIREMENTS. Provided that Supplier is able to provide the Services to Customer at the quality levels set forth in Section 2.9, Supplier shall have the right from time to time, acting in good faith and with reasonable discretion in accordance with its own internal policies and procedures then in effect, and without the prior approval or consent of Customer, to determine which Equipment (or other resources used to provide the Services) shall be used to perform the Services.
ADDITIONAL OPERATING REQUIREMENTS. The NYISO, in consultation with the Connecting Transmission Owner, shall also provide requirements that must be met by the Interconnection Customer prior to initiating parallel operation with the New York State Transmission System or the Distribution System. The Interconnection Customer must comply with all applicable NYISO tariffs and procedures, as amended from time to time. The Interconnection Customer must comply with relevant provisions of the Connecting Transmission Owner’s Electric System Bulletin (O&R - ENGR - 006: Facility Connection Requirements for New Generation, Merchant Transmission And End-User Facilities (Revision 1 - December 1, 2015), including appendices, as amended from time to time, Switching Operating Instruction Manuals, and Transmission Operations Manual (Manual 02), to the extent not inconsistent with the terms of this Agreement or applicable NYISO tariffs and procedures, as amended from time to time. The Interconnection Customer shall provide real-time verbal notifications to the Connecting Transmission Owner’s O&R Energy Control Center prior to connecting or disconnecting any of its inverters.

ADDITIONAL OPERATING REQUIREMENTS. A. The Agent shall be subject to the requirements of this section when, during any twelve month period, 1. three or more of the Agent's checks for weekly sales have been dishonored and ARC has not received immediate reimbursement for such upon demand by ARC; or 2. three or more of the Agent's weekly sales reports, including auditor's coupons and supporting documents, have not been provided to ARC within 96 hours of notice to the Agent from ARC but such are ultimately received, prior to the Agent's termination. B. ARC will provide the Agent with 45 days advance written notice of the effectiveness of this section, which notice shall also be provided to the carriers. The notice will also inform the Agent that the following must be accomplished prior to the effective date of the section: 1. The Agent must provide a bond or letter of credit equal to or greater than its net cash remittances for a current 10 week period. The instrument may be a rider to the existing bond or letter of credit; will be calculated to take into account the amount of the existing bond or letter of credit; and, must conform in all other respects to the provisions of section IV. a. The Agent must surrender traffic documents (paper format) to ARC, with an accompanying inventory summary, so that it retains no more than the highest number of ARC traffic documents issued at each of its locations during any one month in the past twelve months, rounded up to the next even 100. In order to insure the Agent's compliance with this section, ARC will inform the Agent, in the written notice required by this section, of the number of documents, by stock control number, that are permitted to be retained. b. The Agent may possess additional supplies of traffic documents (paper format only), but in no event more than a three month supply, only if it is able to post a bond or letter of credit as provided for in section VIII.D.1.d. 3. The Agent must discontinue the issuance of ARC traffic documents in an electronic format and any and all use of Electronic Ticket Delivery Network(s). 4. Any pending application(s) for an additional approved location will be withdrawn by Agent, and ARC will reject and return to Agent any such application submitted while the Agent is subject to this section. C. If the Agent is not in compliance with the provisions of section IX.B. as of the effective date of this section, or at any time during the period of its effectiveness, ARC will terminate this agreement with the Agent a...
ADDITIONAL OPERATING REQUIREMENTS. ‌ Providing adequate service may require route changes as well as additions in level of service. The Contractor must have available, or be able to acquire in a timely fashion, any additional equipment and/or personnel required for the operation of the project. VCTC shall have the option to add or delete from the given schedule or to re-deploy the service to other areas based on demand or increase of service productivity. Any modification to the routes and schedules will be furnished by VCTC to the Contractor in writing fifteen (15) days prior to the service change. Route modifications caused by non-recurring events (e.g. freeway accident, emergency roadwork) are the responsibility of the Contractor. Route modifications necessitated by recurring events (e.g. street closure, construction detours) are also the responsibility of the Contractor but must be approved by VCTC. In case of an emergency the Contractor shall respond to modifications to service immediately upon request by VCTC.
ADDITIONAL OPERATING REQUIREMENTS. Interconnection Customer must comply with the Connecting Transmission Owner’s operating instructions and requirements, including the following requirements, to the extent not inconsistent with the terms of this Agreement, the ISO OATT, or applicable NYISO procedures.
ADDITIONAL OPERATING REQUIREMENTS. Licensee further agrees and covenants that during the License Term: (a) Subject to (i) compliance with all applicable laws, (ii) the provisions of this Agreement, and (iii) the Management Agreement, Licensee will operate or cause the Project to be operated consistent with the Quality Standard; and (b) It will market, advertise and promote the Project in accordance with market practices of other such gaming and race track destination resorts located in New York and elsewhere in the Northeast; and (c) Upon Licensor’s reasonable request from time to time, it will provide Licensor with copies of any written complaints, evaluations or surveys received or conducted by Licensee concerning the quality of the goods and services provided at the Project, and to the extent that such complaints or evaluations reflect customer dissatisfaction, Licensee will consult with Licensor and give due consideration to Licensor’s suggestions; and (d) It will obtain or cause to be obtained all necessary licenses and permits (including all health, premises, regulatory, and alcoholic beverage or liquor licenses or permits) and governmental authorizations necessary or required for all business in the Project.

  • Operating Requirements Any operating and technical requirements that may be applicable due to Regional Transmission Organization, Independent System Operator, control area, or the Connecting Transmission Owner’s requirements, including those set forth in the Small Generator Interconnection Agreement. Operating Requirements shall include Applicable Reliability Standards.

  • Developer Operating Requirements The Developer must comply with the Transmission Owner’s operating instructions and requirements including but not limited to Transmission Owner’s Operation Coordination Agreement, as it may change from time to time. The Developer must comply with all applicable NYISO tariffs and procedures, as amended from time to time. Whether or not the Large Generating Facility is eligible for the Transition Period LVRT Standard set forth in Appendix G will be determined by the Commission. The Large Generating Facility will comply with the Transition Period LVRT Standard pending issuance of an order by the Commission determining the appropriate LVRT standard. For purposes of compliance with Appendix G, the Transmission Owner has determined that the Developer shall maintain the Large Generating Facility in service during a three-phase fault for 7 cycles. Infrastructure security of New York State Transmission System equipment and operations and control hardware and software is essential to ensure day-to-day New York State Transmission System reliability and operational security. The Commission will expect the NYISO, all Transmission Owners, all Developers and all other Market Participants to comply with the recommendations offered by the President’s Critical Infrastructure Protection Board and, eventually, best practice recommendations from the electric reliability authority. All public utilities will be expected to meet basic standards for system infrastructure and operational security, including physical, operational, and cyber-security practices.
