ACCEPTANCE OF BID AND AWARD OF CONTRACT. 5.3.1 It is the intent of the City to award a Contract to the lowest and best Bidder provided the Bid has been submitted in accordance with the requirements of the Bidding Documents and does not exceed the engineer's estimate or the funds available. The City shall have the right to waive immaterial defects or irregularities in a Bid received and to accept the Bid, which, in the City's judgement, is in its own best interest.
