Separate Software definition

Separate Software means all software supplied by Cohesity or its licensors to Customer under this Agreement, and which is intended for execution on separate hardware/firmware (e.g. agents or backup applications) which Customer is authorized by Cohesity to use;

Examples of Separate Software in a sentence

  • If Buyer transfers the Software as permitted herein, and except as may be provided in a Separate Software License, Buyer may not retain any copies of the Software for its own use and Buyer’s license rights under this Agreement are terminated.

  • Separate Software may be required for standalone and network systems and you should note that the purchase of a particular licence does not imply that RM will provide materials for all computer or network types that you may have at your site.

  • All bank accounts maintained by the Owner Trustee on behalf of the Owner Trust shall be located in the State of Delaware or the State of New York.

  • If no Separate Software License applies, then Seller hereby grants to Buyer, and Buyer accepts, a limited, personal, non-exclusive license, without the right to sublicense, to use the Software only: (1) with the specific Seller’s manufactured Hardware that such Software is intended to operate with; or (2) if the Software is not intended to operate with Seller’s manufactured Hardware, on a single computer owned, leased or otherwise controlled by the Buyer.

  • Separate Software installations related to development, testing or integration of the software prior to deployment to the operational environment will not incur in additional license fees.

Related to Separate Software

  • Service Software means any and all software applications and any third-party or other software, and all new versions, updates, revisions, improvements and modifications of the foregoing, that Contractor provides remote access to and use of as part of the Services.

  • Hosted Software means: (a) Hosted NCR Voyix Software; and (b) Non-NCR Voyix Software provided by a third party as a hosted software application or cloud service and for which Customer purchases a subscription through NCR Voyix pursuant to an Order (“Non-NCR Voyix Hosted Software”).

  • Embedded Software means one or more software applications which permanently reside on a computing device.

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.

  • Custom Software means Software identified as such in Appendix 4 of the Contract Agreement and such other Software as the parties may agree in writing to be Custom Software.
