For purposes of this Section, a Change in Control, as defined in Section 42.8 constitutes an assignment.
If Contractor employs unauthorized workers during performance of this Agreement in violation of the Immigration Act then, in addition to other remedies or penalties prescribed by law, University may terminate this Agreement in accordance with Section 4.28.
If Contractor subcontracts any of the additional subcontracting opportunities identified by University without prior authorization and without complying with 34 TAC Section 20.14, Contractor will be deemed to be in breach of this Agreement under Section 4.28 and will be subject to any remedial actions provided by Texas law including Chapter 2161, Government Code and 34 TAC Section 20.14.
