Protected Software definition

Protected Software means one or more of the following software products: PC Protect, ScanGuard, Total Adblock, TotalAV, Total Password, Total VPN, and Total WebShield. Each individual within the foregoing Class definition is referred to as a “Class Member.” Defendants deny the allegations of the Lawsuit, and the Court has not decided which party is right. The parties have agreed to a Settlement to provide certain benefits to eligible Class Members and to resolve the case without any admission of liability or wrongdoing. The parties have exchanged detailed information about the claims, defenses, and alleged damages in the Lawsuit. After lengthy settlement negotiations overseen by an independent mediator, the parties have reached a proposed Settlement that, if approved by the Court, will resolve the claims asserted against Defendants. Plaintiffs ▇▇▇▇▇ ▇▇▇▇▇▇ (“▇▇▇▇▇▇”) and ▇▇▇▇ ▇▇▇▇ (“▇▇▇▇”) (collectively, “Plaintiffs”) and their counsel believe the Settlement is fair, reasonable, and in the best interests of the Class Members. In entering into the Settlement, Defendants continue to deny any and all allegations of liability, fault, or wrongdoing asserted in the Lawsuit. On , 2024, the Court preliminarily approved the Settlement; certified the Class for settlement purposes only; appointed the law firm of ▇▇▇▇▇▇▇ ▇▇▇▇▇▇▇ LLP as Class Counsel for settlement purposes only; appointed ▇▇▇▇▇▇ and ▇▇▇▇ as the Class Representatives for settlement purposes only; designated CPT Group, Inc. as the Settlement Administrator; and authorized the parties to provide this Notice to the Class.
Protected Software means one or more of the following software as a service products made available to consumers via the internet for download or via application marketplaces: PC Protect, ScanGuard, Total Adblock, TotalAV, Total Password, Total VPN, and Total WebShield. The foregoing Class definition is not an admission that either System1, Inc. or ▇▇▇▇▇▇▇▇▇.▇▇▇ LLC offer any automatic renewal or continuous service subscriptions.
Protected Software of a corporation means a computer program, within the meaning of section 2 of the Copyright Act (Revised Statutes of Canada, 1985, chapter 42), in respect of which the following conditions are met:

  • The Lawsuit is brought on behalf of a Class defined as follows: All California residents who, between October 20, 2019 and June 30, 2024, were enrolled in and charged for an automatic renewal or continuous service subscription for Protected Software offered by any of the Defendants, limited to individuals who did not receive a full refund of any amounts paid towards such automatic renewal or continuous service subscription.

  • If Adobe can demonstrate that such corrective action is unsuccessful in resolving the problem, SEC will take other action as required by Adobe, including stopping shipment of the Protected Software, until corrective measures are successfully implemented.

  • SEC shall employ copy protection, serialization, encryption or any other protection mechanism as may be specified in the applicable Licensed System Addendum to restrict or monitor unauthorized use of Adobe Software, Other Adobe Software and Font Programs licensed hereunder ("Protected Software").

  • Except as would not, individually or in the aggregate, reasonably be expected to be material to Protected and the Protected Subsidiaries, taken as a whole, to the knowledge of Protected, the Protected IT Systems and Protected Software are free of any such viruses and malicious Software.

  • If the SEC's Licensed System is located in a network environment with Protected Software located on a server, SEC shall employ a protection mechanism which permits End Users access to Protected Software only if such use is permitted in the license purchased by the End User from SEC.

  • OEM Customer shall employ copy protection, serialization, encryption or any other protection mechanism as may be specified in the applicable Licensed System Appendix to restrict or monitor unauthorized use of Adobe Software, Other Adobe Software and Font Programs licensed hereunder ("Protected Software").

  • Peerless shall, and require its OEM Customers to, employ copy protection, serialization, encryption or any other protection mechanism as may be specified in the applicable LSA or SDK Appendix to restrict or monitor unauthorized use of Adobe Software, Other Adobe Software and Font Programs licensed hereunder ("Protected Software").

  • No source code for any Protected Software has been delivered, licensed, or made available to any Person other than employees and independent contractors of the Company subject to confidentiality restrictions.

Protected Software. The Kernel, the Monitoring Software and any other Software supporting the Services. Renewal Period: Any additional period of Services offered to Customer as stated in the Order Form. Related to Protected Software

  • Developed Software means software specifically designed for the Principal under the Contract. Depending how advanced its development is, it may be either a Product or a Service or both.

  • Embedded Software means one or more software applications which permanently reside on a computing device.

  • Supported Software means the supported software identified in the Proposal. System means the designated information technology environment in which the Software is to be used. Term means the term of this Agreement specified in clause 2.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Hosted Software means: (a) Hosted NCR Voyix Software; and (b) Non-NCR Voyix Software provided by a third party as a hosted software application or cloud service and for which Customer purchases a subscription through NCR Voyix pursuant to an Order (“Non-NCR Voyix Hosted Software”).
