From Final Acceptance through the expiration of the Warranty Period for the relevant Project, Buyer shall maintain “All Risks” Property Insurance.
If there are determined to be deliverability Network Upgrade costs on the CAISO Grid as an affected system of the Native Balancing Authority as a result of this Project, Buyer can request that Seller elect to fund or elect not to fund all deliverability Network Upgrades.

To the extent damages are covered by any Builder’s Risk policy, property insurance, or other insurance during or after the Project, Buyer shall waive all subrogation and other rights against Contractor and its subcontractors and agents for such damages, except such rights as they may have to the proceeds of such insurance.
If such written notice of rejection of the Goods or claim of shortages and/or damaged Goods is not received within such five (5) day period, and before the Goods have been installed in the Project, Buyer shall be deemed to have waived any right to reject such Goods or to claim shortages and/or damaged Goods.
If a Seller Cost Test is performed during any period during which Buyer is the Scheduling Coordinator for the Project, Buyer shall pay Seller such revenues in the month following Buyer’s receipt of such revenues.
If Buyer disapproves of Final Completion of a Construction Project, Buyer shall also provide an explanation of such disapproval; provided that Buyer shall have no right to disapprove any aspect of the Construction Project previously approved by Buyer under Section 3.3(h) above.
