Tenant acknowledges that its use of the Premises and any Alterations thereto shall comply with the terms, conditions and requirements of: (a) the Environmental Impact Report for Alameda Point and the Mitigation Monitoring and Reporting Program adopted pursuant thereto; (b) the Master Infrastructure Plan; (c) the Town Center and Waterfront Precise Plan (as applicable); and (d) the Alameda Point Transportation Demand Management Plan.
This Amendment to the Precise Plan and Subdivision Agreement may be altered or amended from time to time only by written instruments executed by all the parties hereto.

The Site is located within an area covered by the recently-adopted Precise Plan and shall be developed by the Developer with a mixed-use retail/commercial project as set forth in the Project Description (Exhibit B).
Developer’s Project would also allow City to realize certain goals and objectives of the Downtown Precise Plan as set forth herein.
