PCI Fines and Costs definition

PCI Fines and Costs means the direct monetary fines and penalties owed by the Insured under the terms of a Merchant Services Agreement, but only where such fines or penalties result both from actual or alleged noncompliance with published PCI Data Security Standards by the Insured and from a data breach caused by an incident (or reasonably suspected incident) described in Extension I.2.A.1. (Data Breach), I.2.A.2. (Computer Security Failure) or I.2.A.3 (Failure to disclose); provided, PCI Fines and Costs shall not include, any charge backs, interchange fees, discount fees, or other service related fees, rates or charges.
PCI Fines and Costs means the direct monetary fines and penalties owed by the company under the terms of a merchant services agreement, but only where such fines or penalties result both from the company's actual or alleged noncompliance with published PCI Data Security Standards and from a data breach caused by an electronic business act, an electronic publishing act or a security breach; provided that, PCI fines and costs shall not include, any charge backs, interchange fees, discount fees, or other service related fees, rates or charges.

  • Liabilities and Costs means all claims, judgments, liabilities, obligations, responsibilities, losses, damages (including lost profits), punitive or treble damages, costs, disbursements and expenses (including, without limitation, reasonable attorneys’, experts’ and consulting fees and costs of investigation and feasibility studies), fines, penalties and monetary sanctions, interest, direct or indirect, known or unknown, absolute or contingent, past, present or future.

  • Environmental Liabilities and Costs means all liabilities, monetary obligations, Remedial Actions, losses, damages, punitive damages, consequential damages, treble damages, costs and expenses (including all reasonable fees, disbursements and expenses of counsel, experts, or consultants, and costs of investigation and feasibility studies), fines, penalties, sanctions, and interest incurred as a result of any claim or demand by any Governmental Authority or any third party, and which relate to any Environmental Action.

  • Related Costs means lodging and, if necessary, physical protection for the Covered Person during or while waiting for Transport to the Nearest Place of Safety. Related Costs will include temporary lodging, if necessary, while a Covered Person is waiting to be transported back to the Host Country, Home Country or other country where the Policyholder that sponsored the Covered Person’s Trip is located.   • Clean coal technology demonstration project means a project using funds appropriated under the heading “Department of Energy—Clean Coal Technology,” up to a total amount of $2,500,000,000 for commercial demonstration of clean coal technology, or similar projects funded through appropriations for the Environmental Protection Agency. The federal contribution for a qualifying project shall be at least 20 percent of the total cost of the demonstration project.

  • Environmental Costs and Liabilities means any and all losses, liabilities, obligations, damages, fines, penalties, judgments, actions, claims, costs and expenses (including, without limitation, fees, disbursements and expenses of legal counsel, experts, engineers and consultants and the costs of investigation and feasibility studies and remedial activities) arising from or under any Environmental Law or order or contract with any Governmental Authority or any other Person.
