Ontario Settlement Class definition

Ontario Settlement Class means the settlement class in respect of the Ontario Action as defined in Schedule A.
Ontario Settlement Class means All Persons in Canada who, between January 1, 2003 and December 31, 2013, entered into an FX Instrument[1] either directly or indirectly through an intermediary, and/or purchased or otherwise participated in an investment or equity fund, mutual fund, hedge fund, pension fund or any other investment vehicle that entered into an FX Instrument. Excluded from the class are the defendants, their parent companies, subsidiaries, and affiliates; provided, however, that Investment Vehicles[2] shall not be excluded from the Settlement Class.
Ontario Settlement Class means all Persons resident in Canada who purchased Foam Products in Canada during the Settlement Class Period, except Excluded Persons and Persons who are included in the BC Settlement Class and the Quebec Settlement Class.

More Definitions of Ontario Settlement Class

Ontario Settlement Class means all Persons, other than members of the Quebec Settlement Class or the BC Settlement Class, who purchased Airfreight Shipping Services during the Purchase Period, including those Persons who purchased Airfreight Shipping Services through freight forwarders, from any air cargo carrier, including without limitation, the Defendants, and specifically including LAN. Excluded from the Ontario Settlement Class are the Defendants and their respective parents, employees, subsidiaries, affiliates, officers and directors, and Persons who validly and timely opted-out of the Ontario Action in accordance with the order of the Ontario Court dated March 6, 2008.
Ontario Settlement Class means all Persons resident anywhere in Canada except Quebec as of December 31, 2021, other than Excluded Persons, who between January 1, 2001 and December 31, 2021, inclusive, purchased Packaged Bread either directly or indirectly.
Ontario Settlement Class means all Persons in Canada who, during the Settlement Class Period, purchased Chocolate Products in Canada, except the Excluded Persons and Persons who are included in the Quebec Settlement Class and the BC Settlement Class.
Ontario Settlement Class means the settlement class in respect of the Ontario Film Proceeding that is defined in Schedule “A” to this Settlement Agreement.

  • Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.

  • Viatical settlement broker means a person, including a life insurance producer as provided for in section 508E.3, who, working exclusively on behalf of a viator and for a fee, commission, or other valuable consideration, offers or attempts to negotiate viatical settlement contracts between a viator and one or more viatical settlement providers or one or more viatical settlement brokers. Notwithstanding the manner in which the viatical settlement broker is compensated, a viatical settlement broker is deemed to represent only the viator, and not the insurer or the viatical settlement provider, and owes a fiduciary duty to the viator to act according to the viator’s instructions and in the best interest of the viator. “Viatical settlement broker” does not include an attorney, certified public accountant, or a financial planner accredited by a nationally recognized accreditation agency who is retained to represent the viator and whose compensation is not paid directly or indirectly by the viatical settlement provider or purchaser.
