Ontario Settlement Class definition

Ontario Settlement Class means the settlement class in respect of the Ontario Action as defined in Schedule A.
Ontario Settlement Class means the settlement class in respect of the Ontario Action that is defined in Schedule “A” to this Settlement Agreement.
Ontario Settlement Class means All Persons in Canada who, between January 1, 2003 and December 31, 2013, entered into an FX Instrument[1] either directly or indirectly through an intermediary, and/or purchased or otherwise participated in an investment or equity fund, mutual fund, hedge fund, pension fund or any other investment vehicle that entered into an FX Instrument. Excluded from the class are the defendants, their parent companies, subsidiaries, and affiliates; provided, however, that Investment Vehicles[2] shall not be excluded from the Settlement Class.

More Definitions of Ontario Settlement Class

Ontario Settlement Class means all Persons resident in Canada who purchased Foam Products in Canada during the Settlement Class Period, except Excluded Persons and Persons who are included in the BC Settlement Class and the Quebec Settlement Class.
Ontario Settlement Class means, in respect of each Ontario Action, the settlement class as defined in Schedule A.
Ontario Settlement Class means all Persons, other than members of the Quebec Settlement Class or the BC Settlement Class, who purchased Airfreight Shipping Services during the Purchase Period, including those Persons who purchased Airfreight Shipping Services through freight forwarders, from any air cargo carrier, including without limitation, the Defendants. Excluded from the Ontario Settlement Class are the Defendants and their respective parents, employees, subsidiaries, affiliates, officers and directors, and Persons who validly and timely opted-out of the Ontario Action in accordance with the order of the Ontario Court dated March 6, 2008.
Ontario Settlement Class means all Persons in Canada, except Excluded Persons and Persons who are members of the Quebec Settlement Class, who:

  • Settlement Class means all persons or entities who purchased or otherwise acquired publicly traded Salix common stock or publicly traded call options on Salix common stock, or sold publicly traded put options on Salix common stock, during the period from November 8, 2013 through November 6, 2014, inclusive (the “Class Period”), and were damaged thereby. Excluded from the Settlement Class are Defendants; Salix’s parents, affiliates and subsidiaries (including Valeant Pharmaceuticals International, Inc.); the Officers and directors of Salix and its parents, subsidiaries and affiliates currently or during the Class Period; members of the Immediate Family of any excluded person; any entity in which any excluded person has a controlling interest or had a controlling interest during the Class Period; and the heirs, successors, and assigns of any excluded person or entity. Also excluded from the Settlement Class are any persons and entities who or which exclude themselves by submitting a request for exclusion that is accepted by the Court.

  • Settlement Class Counsel or “Class Counsel” means, collectively, the law firms of Xxxxxx Xxxxxxx Xxxxxxxx Xxxxxxxx LLP; Xxxxxxxxx Xxxxxxx Xxxxx PLLP; Cotchett, Xxxxx & XxXxxxxx, LLP; and Xxxxxxxxx Gluek PLLC.

  • Settlement Class Member means each person and entity who or which is a member of the Settlement Class.

  • Settlement Class Period means the period January 1, 2006 through January 31,

  • Net Settlement Amount means the Gross Settlement Amount minus (a) all Attorneys’ Fees and Costs paid to Class Counsel as authorized by the Court; (b) all Case Contribution Awards as authorized by the Court; (c) all Administrative Expenses; and (d) a contingency reserve not to exceed an amount to be mutually agreed upon by the Settling Parties that is set aside by the Settlement Administrator for (1) Administrative Expenses incurred before the Settlement Effective Date but not yet paid, (2) Administrative Expenses estimated to be incurred after the Settlement Effective Date, and (3) an amount estimated for adjustments of data or calculation errors.

  • Net Settlement Fund means the Settlement Fund less: (i) any Taxes;

  • Master Settlement Agreement means the settlement agreement and related documents entered into on November 23, 1998, and incorporated into a consent decree and final judgment entered into on December 7, 1998, in Kelley Ex Rel. Michigan v Philip Morris Incorporated, et al., Ingham county circuit court, docket no. 96-84281CZ.
