Settlement Class definition

Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.
Settlement Class means all persons who participated in the Plan at any time during the Class Period, including any Beneficiary of a deceased Person who participated in the Plan at any time during the Class Period, and any Alternate Payee of a Person subject to a QDRO who participated in the Plan at any time during the Class Period. Excluded from the Settlement Class are Defendants and their Beneficiaries.
Settlement Class means all Persons who purchased the common stock of iXL between November 30, 1999 and September 1, 2000, inclusive. Excluded from the Settlement Class are the Defendant, the Individuals, members of the immediate families of the Individuals, any entity in which the Defendant has or had a controlling interest, directors and officers of the Defendant and the legal representatives, heirs, successors, or assigns of any such excluded Person. Also excluded from the Settlement Class are those Persons who timely and validly request exclusion from the Settlement Class pursuant to the “Notice of Pendency and Settlement of Class Action” to be sent to potential Settlement Class Members.

The entities identified on Exhibit “A” hereto have timely and validly requested exclusion from the DENSO Settlement Class and, therefore, are excluded.

Excluded from the Settlement Class are Defendants, their present and former parent companies, subsidiaries, and affiliates, federal governmental entities and instrumentalities of the federal government, and states and their subdivisions, agencies and instrumentalities.” The Court adopts and incorporates herein all findings made under Rule 23 in its Preliminary Approval Order.

The Notice Order outlined the form and manner by which the Direct Purchaser Plaintiff would (and subsequently did) provide the DENSO Settlement Class with notice of the settlement, the fairness hearing, and related matters.

It provided due and adequate notice to the DENSO Settlement Class.

This Order and Final Judgment does not settle or compromise any claims by the Direct Purchaser Plaintiff or the Settlement Class against any other Defendant or other person or entity other than DENSO and the other Releasees, and all rights against any other Defendant or other person or entity are specifically reserved.


More Definitions of Settlement Class

Settlement Class means all Persons with a Michigan street address at any time on or before July 30, 2016 who purchased and/or had a subscription to a Hearst Publication on or before July 30, 2016. Excluded from the Settlement Class are (1) any Judge or Magistrate presiding over this Action and members of their families; (2) the Defendant, Defendant’s subsidiaries, parent companies, successors, predecessors, and any entity in which the Defendant or its parents have a controlling interest and their current or former officers, directors, agents, attorneys, and employees; (3) persons who properly execute and file a timely request for exclusion from the class; and (4) the legal representatives, successors or assigns of any such excluded persons.
Settlement Class means the class described in Section II(E)(1) below.
Settlement Class means all Persons or entities who entered into, received or made payments on, terminated, transacted in, or held an ISDAfix Instrument during the Settlement Class Period. Excluded from the Settlement Class are Defendants and their employees, affiliates, parents, subsidiaries, and co-conspirators, should any exist, whether or not named in the Amended Complaint, and the United States Government, and all of the Released
Settlement Class means all Persons or entities, excluding the Defendants, members of the immediate family of each of the Individual Defendants, any entity in which any Defendant has a controlling interest and the legal representatives, officers, directors, heirs, successors or assigns of any excluded party, who purchased Accelerated common stock during the period beginning on June 23, 2000 through and including April 17, 2001. Also excluded from the Settlement Class are those Persons who submit a Request for Exclusion pursuant to this Notice.
Settlement Class or “Class” means the class of persons that will be certified by the Court for settlement purposes only, as more fully described in Section 3.1 herein.
