Settlement Class definition

Settlement Class means, in respect of each Proceeding, the settlement class defined in Schedule A.
Settlement Class means the class described in Section II(F)(3) below.
Settlement Class or “Settlement Class Members” means all Class Members that do not Opt-Out of the Settlement.

  • In addition, objections must be signed by the objecting member of the Settlement Class (and his or her attorney, if individually represented, including any former or current counsel who may be entitled to compensation for any reason related to the objection), and submitted to the Court by filing the objection electronically or in person at any location of the U.S. District Court for the served on Class Counsel and ▇▇▇▇▇ & ▇▇▇▇▇▇▇ IX(M).

  • Any Settlement Class member who fails to file and serve timely a written objection pursuant to this Section shall not be permitted to object to the Settlement or appear at the Final Approval Hearing for the purpose of objecting to the Settlement, and shall be foreclosed from seeking any review of the Settlement or the terms of the Agreement by any means, including but not limited to an appeal.

  • The allocation of the Settlement Fund among the Settlement Class shall be subject to a Court-approved Plan of Allocation.

  • Plaintiffs, by and through Class Counsel, shall, as part of their motion for preliminary approval and motion for final approval, move for certification of the Settlement Class, pursuant to Federal Rule of Civil Procedure 23(b)(3).

  • A member of the Settlement Class may object to this Agreement either on his or her own without an attorney or through an attorney hired at his or her own expense.


More Definitions of Settlement Class

Settlement Class means all persons who participated in the Plan at any time during the Class Period, including any Beneficiary of a deceased Person who participated in the Plan at any time during the Class Period, and any Alternate Payee of a Person subject to a QDRO who participated in the Plan at any time during the Class Period. Excluded from the Settlement Class are Defendants and their Beneficiaries.
Settlement Class means the class described in Section II(E)(2) below.
Settlement Class means all Persons included in the Ontario Settlement Class, the Quebec Settlement Class and the BC Settlement Class.
Settlement Class or “Settlement Class Members
Settlement Class. “Class Member,” or “Settlement Class Member” shall mean each member of the settlement class, as defined in Section III of this Agreement, who does not timely elect to be excluded from the Settlement Class, and includes, but is not limited to, Plaintiff.
Settlement Class or “Settlement Class Members” means those persons who are members of the Class, as set forth in the Class definition in Section 2.07 above, and who do not timely and validly request exclusion from the Settlement Class.
Settlement Class or “Settlement Class Members” means all Proposed Class Members, exclusive of any person who timely opts out of the Settlement pursuant to the procedures set forth below. All persons who timely opt out from the Settlement in conformity with this Agreement shall not be bound by the terms of this Agreement or any Final Judgment entered by the Superior Court and shall retain the right to pursue (or not pursue) any alleged individual claim(s) against the Company in a separate action.
