The Water Pollution (Jersey) Law 2000 has complimentary, but separate, enforcement powers to some elements of the Shipping (Jersey) Law 2002 and the MARPOL Convention (administered by the Maritime Compliance section within Economic Development) and the Harbour Master.
To that end, each Party recognizes the importance of implementing obligations under the International Convention for the Prevention of Pollution from Ships done at London on 2 November 1973 (MARPOL Convention) (5) and taking measures to prevent the pollution of the marine environment from ships.
Footnote 9 A Party shall be deemed in compliance with this provision if it maintains the measure or measures listed in Annex 24‐B implementing its obligations under MARPOL Convention, or adopts any subsequent measure or measures that provide an equivalent or higher level of environmental protection as the measure or measures listed.
In exceptional circumstances, where duly justified by an appropriate analysis by the Commission and in order to avoid a serious and unacceptable threat to the marine environment, ▌the Commission is empowered to adopt delegated acts in accordance with Article 19, amending this Directive, to the extent necessary to avoid such a threat, in order not to apply, for the purpose of this Directive, an amendment to the MARPOL Convention.
Jersey Harbours will inform Environmental Protection and Maritime Compliance if there is a suspected breach of the MARPOL Convention within Jersey territorial waters, once the Convention is enforced in Jersey.
