KNIME Software definition

KNIME Software or “Software” means the KNIME commercial software (excluding any Third Party Software) which is installed by Customer or Customer’s agent at Customer’s premises or at a Customer-controlled space within a third party data center. For avoidance of doubt, neither the KNIME open source software nor any other open source software is covered by this Agreement.

Examples of KNIME Software in a sentence

  • KNIME or its licensors owns or has licenses in and to the Intellectual Property Rights comprising the KNIME Software or parts thereof and any modifications thereto, including, without limitation, any modifications created by or for Customer.

  • KNIME reserves all rights, title, and interest in and to all copies of the KNIME Software.

  • KNIME warrants that KNIME Software shall perform materially in accordance with the online user guide for the applicable KNIME Software.

  • Customer acknowledges that: (a) the Software includes License Control Software that locally records Licensing Metrics and permits KNIME and its authorized service providers, if applicable, the ability to monitor usage of the KNIME Software and (b) use of such License Control Software is fundamental to the business of KNIME.

  • This Agreement does not guarantee that You will make any sales of KNIME Software or Services.

  • Your eligibility to resell KNIME Software or Services may be subject to additional requirements or conditions not described in this Agreement, including additional training, specialization requirements, contractual agreements, and other conditions.

  • Alliance Partner specifically agrees that the KNIME Software will not be used for activities related to weapons of mass destruction, including but not limited to activities related to the design, development, production or use of nuclear materials, nuclear facilities, or nuclear weapons, missiles or support of missile projects, or chemical or biological weapons.

  • KNIME shall only be responsible to provide KNIME Software and Services pursuant to KNIME’s standard terms and conditions or an applicable Statement of Work entered into in writing by KNIME.

  • KNIME may sell or market (whether directly or indirectly through a third party) KNIME Software and Services at any price KNIME chooses without any liability or obligation to You.

  • KNIME may appoint third parties (including those who may compete with you) to sell or market KNIME Software and Services to anyone.

Related to KNIME Software

  • Oracle Software means any software agent, application or tool that Oracle makes available to You for download specifically for purposes of facilitating Your access to, operation of, and/or use with, the Services.

  • Service Software means any and all software applications and any third-party or other software, and all new versions, updates, revisions, improvements and modifications of the foregoing, that Contractor provides remote access to and use of as part of the Services.

  • SAP Software means: (i) any and all software products and Cloud Services licensed to Customer under the License Agreement as specified in software order forms or Cloud Service Order Forms (or other order forms, schedules or appendices as applicable) thereto; (ii) any new releases, updates or versions thereof made available through unrestricted shipment pursuant to the respective support agreement or warranty obligation and (iii) any complete or partial copies of any of the foregoing.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Font Software means software or instructions which, when used on an appropriate device or devices, generates typeface and typographic designs and ornaments. Font Software shall include all Subsets and bitmap representations of typeface and typographic designs and ornaments created by or derived from the Font Software. Font Software includes upgrades or updates (each of which may be provided to you by Monotype in its sole discretion), related files, permitted modifications, permitted copies, and related documentation.
