The Lender acknowledges that (i) no earthquake insurance has been obtained with respect to any Hotel Facilities in California and (ii) insurance maintained by the Operating Lessee in respect of any Hotel Facility shall be sufficient for the purposes of this covenant provided that such insurance complies with the terms of the Operating Lease relating thereto.
