  • The Commitment is not in the nature of a loan to any party or a direct ownership interest in Harken Colombia, an Association Contract or any Subject Interests.

  • Investor represents that it has had an opportunity to ask questions of and receive answers from Owner regarding Owner and Harken Colombia, their respective businesses, properties, financial conditions, operations and plans of business, the Common Shares, and the Subject Interests and all matters relating thereto.
