Excess Packet Loss definition

Excess Packet Loss means packet loss in excess of one percent (1%) between any two points within Exodus' U.S. network.
Excess Packet Loss means that one or more of the TW Companies each experiences sustained packet loss in excess of one percent (1%) between any two points on the AOL Network for thirty (30) minutes or more.
Excess Packet Loss means packet loss in excess of one percent (1%) between any two points within SAVVIS’S’ U.S. network.

  • As an example, if one (1) event causes both Latency and Excess Packet Loss deficiencies, only one credit shall be afforded to the Customer.

  • All credits shall be contingent upon use of TOWARDEX’s measurements for Latency and Excess Packet Loss.

  • After being notified of any Excess Packet Loss or Latency on the TOWARDEX Network, if TOWARDEX fails to remedy such Excess Packet Loss or Latency within two (2) hours of notice or otherwise becoming aware of Excess Packet Loss or Latency, TOWARDEX will credit Customer's account the pro-rata monthly charges (based upon the number of hours of Excess Packet Loss or Latency that exceeds the initial two (2) hours) for such continuous Excess Packet Loss or Latency.

  • DWNI will never apply a credit under Section 7.2 for any Excess Packet Loss or Latency for which Customer received a credit under Section 7.3. Sections 7.2, 7.3 and 7.4 above state Customer's sole and exclusive remedy for any and all failures by DWNI to provide Services or adequate Service levels under this Agreement or otherwise, including but not limited to any outages or Network congestion.

  • After discovering or being notified by Customer of packet loss in excess of one-half percent (0.5%) (“Excess Packet Loss”) or transmission latency (“Latency”) based on SGN’s measurements in excess of 3 milliseconds from a SGN router to any of SGN’s transit carriers, SGN will use commercially reasonable efforts to determine the source of such Excess Packet Loss or Latency and to correct such problem to the extent that the source of the problem is on the SGN Network.

  • SGN will not apply a credit under A.2 for any Excess Packet Loss or Latency for which Customer received a credit under Section A.3. Sections A.2, A.3 and A.4 above state Customer's sole and exclusive remedy for any failure by SGN to provide Bandwidth or adequate service levels, including but not limited to any outages or SGN Network congestion.

  • NET ALLCORRECT S.A.S. will issue Service Credits to Customer’s account for the period commencing at the time of receipt notification from Customer until the average Packet Loss for the preceding thirty (30) days is less than 0.1% provided that in no event shall the Service Credits exceed 100% of the NET ALLCORRECT S.A.S. Network Access Fees for the calendar month in which the Excess Packet Loss occurs.

  • If NET ALLCORRECT S.A.S. fails to remedy such Excess Packet Loss within two (2) hours of being notified of any Excess Packet Loss on the NET ALLCORRECT S.A.S. Network and average Packet Loss for the preceding thirty (30) days exceeds 0.1%.

More Definitions of Excess Packet Loss

Excess Packet Loss means a Packet Loss in excess of one half of one percent (0.5%) for a calendar month within the Shared Network, subject to the exclusions in Section 5.0(g).
Excess Packet Loss and/or “Latency” shall be defined as follows: (a) Packet Loss is measured as the percentage of lost packets, averaged over a thirty (30) day month (720 hour) period, from IP POP to IP POP; (b) Latency is measured as the round trip time, averaged over a thirty (30) day month (720 hour) period, for an IP packet to travel from core IP POP to IP POP.
Excess Packet Loss means packet loss in excess of one percent (1%) between any two points within Fastech/Prescient Prescient’ network.
Excess Packet Loss means packet loss in excess of one percent (1 %) between any two points within C&W's network.

  • Excess Payment means the amount paid by any Guarantor in excess of its Ratable Share of any Obligations; (b) “Ratable Share” shall mean, for any Guarantor in respect of any payment of Obligations, the ratio (expressed as a percentage) as of the date of such payment of Obligations of (i) the amount by which the aggregate present fair salable value of all of its assets and properties exceeds the amount of all debts and liabilities of such Guarantor (including contingent, subordinated, unmatured, and unliquidated liabilities, but excluding the obligations of such Guarantor hereunder) to (ii) the amount by which the aggregate present fair salable value of all assets and other properties of all of the Loan Parties exceeds the amount of all of the debts and liabilities (including contingent, subordinated, unmatured, and unliquidated liabilities, but excluding the obligations of the Loan Parties hereunder) of the Loan Parties; provided, however, that, for purposes of calculating the Ratable Shares of the Guarantors in respect of any payment of Obligations, any Guarantor that became a Guarantor subsequent to the date of any such payment shall be deemed to have been a Guarantor on the date of such payment and the financial information for such Guarantor as of the date such Guarantor became a Guarantor shall be utilized for such Guarantor in connection with such payment; and (c) “Contribution Share” shall mean, for any Guarantor in respect of any Excess Payment made by any other Guarantor, the ratio (expressed as a percentage) as of the date of such Excess Payment of (i) the amount by which the aggregate present fair salable value of all of its assets and properties exceeds the amount of all debts and liabilities of such Guarantor (including contingent, subordinated, unmatured, and unliquidated liabilities, but excluding the obligations of such Guarantor hereunder) to (ii) the amount by which the aggregate present fair salable value of all assets and other properties of the Loan Parties other than the maker of such Excess Payment exceeds the amount of all of the debts and liabilities (including contingent, subordinated, unmatured, and unliquidated liabilities, but excluding the obligations of the Loan Parties) of the Loan Parties other than the maker of such Excess Payment; provided, however, that, for purposes of calculating the Contribution Shares of the Guarantors in respect of any Excess Payment, any Guarantor that became a Guarantor subsequent to the date of any such Excess Payment shall be deemed to have been a Guarantor on the date of such Excess Payment and the financial information for such Guarantor as of the date such Guarantor became a Guarantor shall be utilized for such Guarantor in connection with such Excess Payment. This Section 10.06 shall not be deemed to affect any right of subrogation, indemnity, reimbursement or contribution that any Guarantor may have under Law against the Borrower in respect of any payment of Obligations.

  • Excess Collections shall have the meaning specified in Section 2.8(a)(xv) of the Indenture.

  • Excess property means property under the control of any Federal awarding agency that, as determined by the head thereof, is no longer re- quired for its needs or the discharge of its responsibilities.
