Developer Work definition

Developer Work means all duties, responsibilities, and obligations to be performed by Developer as contemplated by Section 3.2 of this Agreement.
Developer Work means, collectively, the Building Completion Work and the Punch List Work.
Developer Work means the completion of the following, in each case as shown on the Plans: (a) the core and shell of the Building, including, without limitation, the foundation and entire exterior envelope (including, without limitation, the curtain wall, windows and roofs (whether setback or otherwise)) of the Building, the Coach Atrium, and the entire superstructure (including, without limitation, the foundations, columns, girders, beams, supports, all support and other features necessary for the installation of raised flooring, and concrete floor slabs) of the Building, including, without limitation, with respect to Office U▇▇▇ ▇▇ and Office Unit 2B in accordance with the specifications required by the Coach Member as shown on the Plans (and the parties agree that no portion of the incremental costs of so constructing Office U▇▇▇ ▇▇ and Office Unit 2B over the Base Building standard specifications shall be allocated to the Coach Member or included in Coach Total Development Costs); (b) all Common Elements (but excluding the Office Unit 3 Exclusive Use Common Elements (as defined in the Condominium Declaration)); (c) the Coach Exclusive Systems and the Coach Shared Building Systems and Areas (i.e., all Building systems other than those Building systems which are exclusive to the Additional Office Units); (d) the Coach Areas; (e) the core bathrooms within the Coach Unit and within Office U▇▇▇ ▇▇ and Office Unit 2B (and the parties agree that no portion of the incremental costs of so constructing the core bathrooms in Office U▇▇▇ ▇▇ and Office Unit 2B over the Base Building standard specifications shall be allocated to the Coach Member or included in Coach Total Development Costs; provided, that the excess of the actual costs of completing the interior finishes thereof over the allowance therefor contained in the Budget shall be allocated to the Coach Member and included in Coach Total Development Costs); (f) all sidewalks, including paving, surrounding the Building; (g) the Podium; (h) the Landscaping; (i) the Base Building Lighting; (j) the Loading Dock Unit; (k) the Parking Unit; (l) the Developer TCO Work; and (m) all entrances and points of ingress to and egress from the Building. For the avoidance of doubt, the Developer Work shall not include any Finish Work (including any Additional Developer Work).

  • Any material amendment to the Project Architect Agreement, and any new contract with KPF or any substitute Project Architect, and any material amendment to any such new contract, in each case which affects or would reasonably be expected to affect the Developer Work or the Coach Total Development Costs shall be subject to the Coach Member’s prior written approval, which approval shall not be unreasonably withheld, conditioned or delayed.

  • Developer shall use Best Efforts to complete all Developer Work and achieve Final Completion on or prior to June 30, 2017 (the “Outside Completion Date”), subject to extension for Force Majeure delays and delays caused by Coach Legacy or any of its consultants or contractors.


More Definitions of Developer Work

Developer Work means the completion by Developer of the following, in each case in accordance with the Plans to the extent applicable: (a) the core and shell of the Tower Building and any other Base Building Work; (b) such other portions of the Building as shall be necessary (i) to complete the PE Exclusive Areas or the PE Shared Building Systems and Areas or (ii) to cause any such areas or systems to be operational and reasonably accessible to PE Member and its Affiliates and their respective employees; (c) the Required Destination Retail Building Work (other than portions of such work to be exclusively used or occupied by Other Members); (d) the PE Areas; (e) the core bathrooms within the PE Unit; (f) all sidewalks, including paving, directly adjacent to the Tower Building; (g) all Landscaping; (h) all Base Building Lighting; (i) all entrances and points of ingress to and egress from the Tower Building; and (j) the Subway Entrance. For the avoidance of doubt, the Developer Work (i) shall not include any PE Finish Work, and (ii) shall include the foundation and entire exterior envelope of the Tower Building (including the curtain wall, windows and roofs (whether setback or otherwise)) and the entire superstructure of the Tower Building (including the columns, girders, beams, supports, all support and metal deck floor slabs).
Developer Work means the work that is the sole responsibility of the Developer to complete prior to issuance of a certificate of occupancy for any structure on the Developer’s Property. Developer Work includes, but is not limited to, the following items included herein:  Roadway/Corridor Improvements: o Final grading of right-of-way corridor within the Phase 1 Area o Subgrade preparation; all lifts of asphalt paving; construction of concrete curb and gutter, bioswale, landscaped snow storage area, concrete sidewalk, and asphalt shared use path within Phase 1 Area o Construction of retaining walls within the Phase 1 Area o Rough grading for utilities installation and emergency vehicular egress within the Phase 2 Area. A minimum 10-foot-wide vehicle path shall be graded for emergency access and shall extend from ▇▇▇▇▇ Road to the western boundary of Phase 1 Area. o Construct lighting within the Phase 1 Area.  Stormwater: o Complete construction of stormwater collection, conveyance, and treatment system and associated appurtenances in Phase 1 Area and Phase 2 Area as shown in the approved Plans, except for items of work identified in Section 2.4 of this Agreement.  Sanitary Sewer: o Construction of all sanitary sewer mains, manholes, and associated appurtenances within Phase 1 Area. o Construction of sanitary sewer mains, manholes, and associated appurtenances up to and including manhole SSMH-1 as shown in the approved Plans that is within the Phase 2 Area.  Domestic Water: o Construction of all watermain and associated appurtenances within Phase 1 Area and Phase 2 Area, except for the partial construction of the fire hydrant runs within the Phase 2 Area. For each fire hydrant within the Phase 2 Area, the Developer shall install a mainline tee, hydrant valve, and blind flange/plug on the hydrant valve.  Irrigation: Complete construction of irrigation district pipe, manholes, and all other associated appurtenances in the Phase 1 Area and Phase 2 Area.  All other items of work as shown in the approved Plans and/or as necessary for a complete and operable roadway for complete and operable irrigation, stormwater, sanitary sewer, and water systems.
Developer Work shall have the meaning ascribed thereto in the Development Agreement.

Related to Developer Work

  • Project Work means the work required to complete the Project.

  • The Work means the work or works to be executed or done under this contract.

  • Major Work means any Work to Construct or Maintain the Distribution System that costs more than One Hundred Thousand ($100,000.00) Dollars;

  • Development Work means all work and services necessary or desirable in connection

  • Contract Work means everything required to be furnished and done by the Contractor by any one or more of the parts of the Contract referred to in Article 1, except Extra Work as hereinafter defined.
