Customer Error definition

Customer Error means an error in the functioning of the Materials which results from (i) defects, problems, failures, or use with hardware, software or other components or systems not provided by ChemWare; (ii) use with Unsupported Items; (iii) negligence of Customer or other non- ChemWare personnel; or (iv) modification of the Materials by Customer, including without limitation changes made by Customer to the control tables and computation routines in a manner inconsistent with the Documentation or ChemWare-provided training. Customer Error shall also mean an error resulting from Customer’s use of the Materials (v) in a manner that is not within ordinary use of the Materials as described in the Documentation; or (vi) in a computing environment not certified or recommended by ChemWare for use with the Materials.

Examples of Customer Error in a sentence

  • Service Availability is calculated as a percentage by dividing the number of minutes the Service is available during the applicable month by the number of total minutes in the applicable month, excluding in all cases Scheduled Maintenance, Customer Error Incidents, and Force Majeure.

  • Service Availability is defined as the time that the Service can receive, process, and respond to requests, excluding (a) Scheduled Maintenance, (b) Customer Error Incidents, and (c) Force Majeure.

  • An interruption in the Subscription Services shall not be considered a breach of Licensor’s obligations hereunder if: (i) Licensor promptly takes all reasonable steps to restore the Subscription Services; or (ii) the interruption in Subscription Services results from a Customer Error Incident, a Force Majeure, regularly scheduled or emergency maintenance, or due to an Internet Disruption.

  • Licensor shall make reasonable efforts to provide production environment service availability of 99% measured on a quarterly basis (“Service Availability”) not including (i) Customer Error Incidents, (ii) Force Majeure and (iii) Internet Disruptions.

  • Notwithstanding, provided Customer is not in default hereunder, and to the extent that SKYWIRE has developed such, SKYWIRE shall make available to the Customer Error Corrections and Modifications.

  • An interruption in the Subscription Services shall not be considered a breach of Licensor's obligations hereunder if: (i) Licensor promptly takes all reasonable steps to restore the Subscription Services; or (ii) the interruption in Subscription Services results from a Customer Error Incident, a Force Majeure, regularly scheduled or emergency maintenance, or due to an Internet Disruption.

  • The foregoing Error support, does not include Errors caused by Customer’s control or influence, and which cannot be contributed to Errors caused by Logis’ Cloud Services (a "Customer Error").

  • Licensor shall make reasonable efforts to provide production environment Service availability of 99% measured on a quarterly basis (“Service Availability”) not including (i) Customer Error Incidents, (ii) Force Majeure and (iii) Internet Disruptions.

  • If Customer notifies ChemWare of an Error, and after investigation by ChemWare it is determined that the problem is the result of Customer Error, ChemWare reserves the right to ▇▇▇▇ Customer as an Other Service for all time and expenses accrued in making this determination.

  • Service Availability is defined as the time that the Service can receive, pro- cess, and respond to requests, excluding (a) Scheduled Maintenance, (b) Customer Error Incidents, and (c) Force Majeure.

Related to Customer Error

  • Customer User means an employee of Customer, a Customer Affiliate or Business Partner.

  • Customer Portal means a web portal maintained by Liferay or a Liferay Affiliate that provides for various resources accessible to Liferay Subscription customers as further described in Section 2.1 below.

  • Customer Data means any content, materials, data and information that Authorized Users enter into the production system of a Cloud Service or that Customer derives from its use of and stores in the Cloud Service (e.g. Customer-specific reports). Customer Data and its derivatives will not include SAP’s Confidential Information.

  • Customer Usage Data means the Telecommunications Services usage data of a CLEC End User measured in minutes, sub-minute increments, message units, or otherwise, that is recorded by SBC-13STATE and forwarded to CLEC.

  • Customer means the State agency or other entity identified in a contract as the party to receive commodities or contractual services pursuant to a contract or that orders commodities or contractual services via purchase order or other contractual instrument from the Contractor under the Contract. The “Customer” may also be the “Buyer” as defined in the PUR 1001 if it meets the definition of both terms.
